The amendments to the Law on Protection of the Population against Infectious Diseases, prepared by a working group of the Government of Serbia, will stipulate that the communal militia issue a foul order for failure to comply with the prescribed measures to prevent the spread. Covid 19 virus.

This means that the communal militia will be able to issue a foul order to citizens if they do not wear masks in the prescribed places, to pay a fine in the amount of 5,000 dinars, which they can pay reduced by half, in the amount of 2,500 dinars, within eight days.

The same occurs with legal persons, businessmen and catering establishments, who will be fined for non-compliance with the measures that apply to them – such as the distance between tables, the lack of disinfectants, or watchmen’s crowns …

More sanctions are provided to them.

The new authorization to issue a foul order will refer only to the communal militia, and not to members of the Ministry of the Interior, as reported by some media, Tanjug was confirmed in the working group of the Government of Serbia.

The fines, which can be imposed by order of fault for violation of measures, will not be increased, they will be in the fixed amounts already prescribed, and now they are not in the plan for modifying the Law of Offenses.

The president of the Belgrade Misdemeanor Court, Olivera Ristanovic, clarified to Tanjug that the misdemeanor order issued by the communal militia must contain the reason for the issuance, the article of the decree or law that is being violated and the total fixed amount to be paid. .

The misdemeanor order works like other mandatory fines, provided for improper parking or traffic violations, so that the person to whom the order was issued can pay half of the fine within eight days of the date of issue , thus fulfilling its obligation.

“If you want to challenge the misdemeanor order, the person can submit a request for a judicial decision to the misdemeanor court within the same eight-day period,” Ristanovic said.

If you do not do either, the warrant arrives with the finality and enforceability clause and the issuer of the warrant sends it to court for enforcement, added the president of the Belgrade misdemeanor court.

He mentioned that even after the eight-day period has expired, the person can pay the fine of the order, but in full, because if he does not pay the full amount of the fine, the rest goes back to court for compulsory execution.

In addition to the aforementioned novelties, the amendments to the Law will prescribe the notion of home quarantine,

Tamara Stojčević, undersecretary of the government of Serbia and member of the working group for the name of the Law on Protection of the Population against Infectious Diseases, told Tanjug earlier.

He stressed that these are only urgent changes, pointing out that this Law must be harmonized with the recommendations and regulations of the World Health Organization.

She hopes that the proposed changes will be presented to the Serbian government next Thursday, that is, together with the budget rebalancing, and then to the Serbian parliament deputies for adoption.
