After Darko Elez, noted as one of the biggest criminals in the region, was arrested in Serbia, his lawyer explained that there was no legal basis for Elez to be extradited to Bosnia and Herzegovina, on whose orders he was arrested and taken into custody.
After several years away from the public eye, the local media heard the news a few days ago that a well-known Balkan convicted criminal, Darko Elez, was arrested in Batajnica, on the premises of his wife’s company.
The Ministry of Justice of the Council of Ministers of Bosnia and Herzegovina requested the extradition of Serbia.
– The request of the Ministry of Justice of Bosnia and Herzegovina requests the extradition of ED for criminal proceedings and trial before the Court of Bosnia and Herzegovina for the crime of organized crime under article 250, paragraph 2 of the Criminal Code of Bosnia and Herzegovina , in relation to the crime of organized crime under article 383 A, paragraph 2 of the Criminal Code of the Republika Srpska. – declared the High Court of Belgrade.
However, Darko Elez’s lawyer explained in a letter to “Novosti” that there is no legal basis for such a request.
– Darko Elez is detained in extradition and no criminal proceedings are being carried out against him in the Republic of Serbia, especially in relation to what was speculated in the previous days. On the other hand, Darko Elez cannot be extradited to BiH at his request because it would violate the Bilateral Extradition Agreement, concluded between the Republic of Serbia and BiH in 2013, that is, the Confirmation Law of this Extradition Agreement, the letter says. of the lawyer. Goran Karadarevic, who represents the recently arrested Elez.
It is added that the extradition request of his client and the additional request of Bosnia and Herzegovina do not meet the formal requirements for extradition.
– The request refers to the facts prior to the conclusion of the agreement with Bosnia and Herzegovina, while those facts cannot be extradited by the citizens themselves and Elez is a citizen of the Republic of Serbia. Such extradition would violate the Constitution of the Republika Srpska, international treaty and law, and violate the rights of Darko Elez, who is a citizen of the Republic of Serbia, says Karadarevic.
As for the additional request, the lawyer explains, it refers to subsequent events (2018 and 2019), but it also does not meet the formal conditions for Elez’s extradition.
– In connection with this, flat-rate documents were submitted that are not important and cannot be documents on the basis of which extradition would be allowed. I want to say that Darko Elez, as a citizen of the Republic of Serbia, has not had any connection with Bosnia and Herzegovina for a long time, so it is very surprising that he is connected with some events of 2018 and 2019. For this reason, I hope that All state bodies of the Republic of Serbia, in order to preserve the sovereignty of the country, if they have something controversial in relation to my client, initiate certain procedures in accordance with the principle of territoriality. What is happening at the moment does not affect the constitution of our country at all, because you cannot say that someone is the author of a crime without initiating a process against them, or at least listening to them in any capacity – affirms the lawyer.
As a reminder, Elez, who has already served a nine-year prison sentence in our country, led a luxurious and comfortable life in Serbia, and as the media in our capital reported, he also had a house in his possession.

Smuggling, theft, drugs
Elez began his career with cigarette smuggling, then weapons, theft, and vehicle reselling, and climbed the hierarchical ladder of the underworld when he organized the sale of drugs. He was arrested in Serbia in 2009 and sentenced to nine years in prison for smuggling marijuana from Serbia to Bosnia and Herzegovina, attempted extortion and forgery of documents.
He served his sentence in Sremska Mitrovica Penitentiary and, due to his good behavior, was released earlier, in November 2017.
Spokesperson for the prosecution, Boris Grubesic, says Elez is being sought for prosecution on the basis of a confirmed indictment charging him with organized crime in connection with several serious crimes, including murder, attempted murder, money laundering and other acts committed between 2005 and 2009, adding that Elez was under investigation and for serious crimes committed in the East Sarajevo area between 2017 and 2019.
As “Kurir” wrote after his arrest, referring to unofficial information, Elez is under investigation for the murder of the owner of the restaurant “Rodeo” Siniša Milićević Tigar in May 2018, as well as the murder of the owner of the club “Sparta” , Miloš Ostojić, in January last year.
