The Law on Determination of the Origin of Property and the Special Tax will begin to apply on March 12 and next week the National Assembly will discuss the modifications to the law that specify the terms.
The Ministry of Justice indicates that the law will apply equally to all citizens. So not just politicians and the stage and officials, but also other citizens who find a disproportion between reported income and increased property.
Practically, anyone who is suspected or determined to have, for a maximum of three consecutive calendar years, a difference of more than 150,000 euros between the increase in assets and the declared income, will be affected by the law. During the inspection, it will practically be a matter of checking the property, which will be carried out by a special unit of the Tax Administration.
Who will be checked will be determined by the annual guidelines issued by the director of the Tax Administration, which are not public, but the process can be initiated at the request of citizens or any institution.
The law stipulates that illegally acquired property is taxed at a tax rate of up to 75 percent. Likewise, if the property inspection procedure indicates the reasons for suspicion that a crime has been committed, the Tax Administration unit informs the Police, the Tax Police and the Public Ministry.
In translation, the law stipulates that whoever cannot prove that they legally acquired the property will be left without 3/4 of its value, and if the court determines that the property was acquired for a crime, all illegally acquired property could be confiscated . .
The Ministry of the Interior, the NBS, the Anti-Money Laundering Administration, the Anti-Corruption Agency, the Geodetic Authority of the Republic, the Commercial Registries Agency and the Central Registry, Deposit and Securities Clearing must also delegate their members to the special unit. of the Tax Administration, which will direct and conduct the securities processing.
