The Podgorica High Court ordered a new experience of the maritime accident at the Budva Aquarium, in which the police Maja Sljivancanin was killed on July 11, when a small motorboat driven by a 17-year-old girl from Belgrade collided with a boat with her promised, lawyer Zdravko Begovic said.

In October, the High Court panel accepted the appeal of the Kotor Basic Prosecutor’s Office and reversed the verdict that the minor was sentenced to increased supervision by the guardianship authority and 120 hours of socially useful work.

“The first instance verdict was overturned due to the incomplete factual situation. The second instance court ordered a new expert opinion in this case,” said lawyer Begović.

He also stated that the decision to overturn the lower court ruling was based on the findings of the Superior Court’s expert service, which includes psychiatrists and a psychologist.

“The professional service conducted a conversation with the minor, after which this team of experts gave a finding and a recommendation on what type of sanction would be appropriate to his psychophysical development and age,” explained lawyer Begović.

He is accused of negligently causing a maritime accident in which Maja Sljivancanin was killed while her fiancé Vladimir Stanisic was injured.

Both the yacht and the ship were moving from the island of Sveti Nikola to the Jaz beach.

The minor said at trial that he did not see the boat in front of him.

According to the first finding of the maritime and traffic expert, in addition to the 17-year-old Vladimir Stanišić, who was driving the boat with Budva license plates, and in which his fiancee was also, he contributed to the maritime accident.

“The maritime accident in which a person died on July 11 occurred due to the failure to comply with international standards to avoid collisions at sea of ​​both participants in the maritime accident,” says the finding of the expert Aleksandar Božović.

The minor, according to the finding, caused a maritime accident by not adhering to international regulations on the prevention of collisions at sea, as well as article 10 of the Maritime Navigation Safety Law.

Analysis of the damage to the ship BD-213, which was struck by the yacht, as well as the VTMIS recordings, showed that Vladimir Stanišić did not observe the navigation area and did not take the action of stopping or turning to the right when the object it was coming to his right.

In mid-August, the Kotor Court of First Instance accepted bail in the amount of 332,000 euros offered by the family of a minor, otherwise the son of a well-known businessman, to defend themselves against charges of causing the accident.
