Nis’s computer scientists were questioned before the Belgrade High Court, whose extradition is being requested by the United States for Internet fraud, money laundering conspiracy and the formation of fake investment funds, as a result of which American investors were allegedly harmed by some 70 million dollars. The US judiciary asks for an agreement with Serbia on extradition in the case of criminal acts for which a sentence of more than one year in prison is threatened. The agreement was signed in 2016 and entered into force last year.

This is not a court in North Texas, but today the Belgrade High Court acted on behalf of the American court that indicted ten citizens of Serbia and one citizen of the Philippines who is married to the first defendant and sent an extradition request to the Serbian judiciary. However, the application does not contain witness statements or cite evidence against the accused.

“We do not know if that accusation has been examined long enough for the evidence that was the basis of the accusation to be really valid. We have not seen any evidence and that is our main objection. Nor is there a statement from at least one victim from the north. from Texas to say – I invested money and they hurt me, ”said Milan Petrović, the attorney for the first defendant in the Kristijan Krstić and Ksenija Fejailang case.

But under the agreement the United States and Serbia signed in 2016, and which came into effect last year, the party seeking people is not even required to bring the accusation to the other party.

“I would not provide additional information about the case itself and whether or not they committed the acts charged against them. We are talking here exclusively about whether people should be extradited to America or not. The defense position is that there are no legal conditions. for our citizens to be extradited, and we ask the court to reject the US request, “said Ljubomir Ivanovic, attorney for the two defendants.

The High Court now has a difficult task: to assess whether the older Constitution and International Legal Assistance Law or the international agreement that Serbia has concluded with the United States.

“My proposal was to try them here. Because there is no reason for them to be extradited. This country has the capacity and all the conditions for that kind of trial. There is no special reason for them to be sent there except for that agreement,” said Dragoš Cukavac . lawyer for Nenad Mladenović.

The extrajudicial panel of the Superior Court could make a decision on the extradition next week, but then follows the appeals procedure and the hearing of the parties before the panel.

The Chamber may also request additional information from the United States, which can take several months. Until the decision, IT staff remains in custody.
