Amendments to the Law on the Protection of the Population against Infectious Diseases will be on the Serbian Parliament’s agenda on 10 November. A member of the task force to change the law, Tamara Stojčević, told H1 that personal protection measures are being introduced into the law, but also that responsibility for personal health and the health of our environment is being strengthened. Milena Vasić, a lawyer for the Lawyers Committee for Human Rights, says the changes themselves are not debatable and were necessary even earlier.

It highlights that the fines will remain the same: 5,000 dinars for not wearing a mask or failure to comply with other prescribed measures for individuals and 50,000 to 300,000 for legal entities, but that their application will be more efficient and faster.
The punishments, by the way, are related to not wearing masks indoors, but also to maintaining a social distance.
Stojčević says that the measures introduced – masks, keeping your distance and respecting personal protection measures – proved to be important and so they decided to emphasize them.
“I call on citizens to respect them and wear masks,” Stojčević said, specifying that we have a government decree ordering the use of masks, but that their violation meant starting a process before a misdemeanor judge, and that now punishment is being introduced. In the instant.
“The objective is not to punish citizens, but rather the need to wear masks, protect themselves, the family and the environment,” he emphasized.
When asked why the law is being changed only now, Stojčević says that the measures and sanctions have been measured and examined: how effective they are and how much they affect preventing infections in the most effective way possible.
“After eight months of fighting this evil disease, it has reached the point where one of the most important measures is personal protection,” Stojčević said.
He stressed that community inspectors and militiamen will also be able to control the application of measures in public transport.
Vasic: Amendments to the law were needed before
Attorney Milena Vasić says that these changes to the law were necessary before and that during the state of emergency there was confusion and the possibility of double punishment and offense and misdemeanor for the same behavior, which is why the Constitutional Court declared them unconstitutional.
“The changes in and of themselves are not debatable, clear and transparent sanctions are necessary for us in the legal system so that we can regulate people’s behavior,” Vasic added.
It also indicates that the confusion in the public was generated by the fact that the measures were adopted, especially by the use of masks at the recommendation level, and were not subject to sanctions.
“Now we have finally clarified that part to the public and that is very important,” Vasic said, but added that there is still a risk of double sanction, so it is important that all those involved in the sanction process receive clear guidelines on what situations will apply the infraction. , and in what constitutes a criminal offense, because we run the risk of someone being sanctioned twice according to the Penal Code and the Law for the Protection of the Population against Infectious Diseases.
When asked why the introduction of the rules on punishment was expected until now, he said that it was difficult for lawyers to send what was prohibited and what was not, and assessed that he was not prepared and that no one expected an epidemic of this magnitude .
He emphasized that the question is how to change everything in practice, because it is impossible to go and measure the distance between people with a meter, and that he believes that sanctions will be applied where large crowds are made and the measures are arrogantly violated.
“We will see that based on the behavior of the communal militia and the police … That is why I say, it is not enough just to change the law, but also clear guidelines that the Ministry of Health, Interior and Justice must develop,” Vasic said. .
