Serbia will extradite a person to the United States due to the Internet fraud procedure

On October 20, the Extrajudicial Criminal Chamber of the Special Department for Organized Crime of the Superior Court of Belgrade issued a decision determining that the legal requirements for extradition to the United States of America have been met to carry out the proceedings in the Court. The judicial statement recalls that on September 30, the investigating judge of the Superior Court heard, among others whose extradition is requested, AS, who, it is said, stated in the presence of elected defense attorneys that he wants to be extradited to the United States.

It should be remembered that the Nis computer scientists were heard before the Belgrade High Court, whose extradition is requested by the United States for Internet fraud, money laundering conspiracy and the formation of false investment funds, for which American investors were allegedly harmed for about $ 70 million. Eleven people residing in Nis, mostly Serbian citizens with dual citizenship, have been detained since July 24.

The announcement of this decision indicates that the Deputy Prosecutor for Organized Crime stated that he considers that the procedural conditions precedent for extradition have been met, that is, to address the request, and that the request with attachments presented with the request for extradition of our Citizens of the United States fully agree with the Law on International Legal Assistance in Criminal Matters and with the provisions of the bilateral Agreement that Serbia has with the United States regarding the extradition of persons charged in one of these states.

The Extradition Chamber of the Belgrade High Court, Special Department for Organized Crime, determined that the conditions for the extradition of AS, a citizen of the Republic of Serbia, were met, given that Article 3 of the Extradition Treaty between the Republic of Serbia and the United States. It will not be denied on the basis of the nationality of the person whose extradition is requested, then extradition will be allowed for criminal prosecution for crimes punishable by a prison sentence of more than one year under both the law of the requesting State and the law of the requested State. the request, supported by the annexes prescribed by the provision of article 8 of the Extradition Treaty, will be indicated, among other things, in the declaration.

It is added that the Extraordinary Criminal Chamber made a decision taking into account that in this case there are no obstacles to the extradition of AS persons under the simplified procedure to the judicial authorities of the United States, prescribed by the Agreement between the Republic of Serbia on extradition , that is, the International Legal Assistance Law. in criminal matters, and appreciating the fact that AS stated that he wanted to be extradited through a simplified procedure.

The proceedings will be carried out in the criminal case of the United States of America against KK and others for conspiracy to commit fraud involving electronic communications.
