The Belgrade High Court has decided to extradite only one of the 11 programmers arrested in the United States for digital fraud. The young man who is being extradited, as it is written in the announcement of the Court, asked to be tried in America, which demanded the extradition of all on the suspicion that they deceived American citizens and thus earned 70 million dollars.
The Superior Court says that the AS sought by this country will be arrested in the United States to stand trial because it harmed its citizens financially.
According to the statement, AS said at the September 30 hearing that he wanted to be extradited to the United States according to a simplified procedure.
Extrajudicial Criminal Chamber of the Special Department for Organized Crime of the High Court in Belgrade on October 20, 2020. approved a decision establishing that the legal preconditions for extradition to the United States of America have been met in order to carry out conduct proceedings before the United States District Court in the Northern District of Texas, as stated in the announcement.
The process will take place in the criminal case of the United States of America against KK and others for conspiracy to commit fraud.
Fraud includes electronic communication of the violation of Chapter 18 of the US Penal Code, of Articles 1349 and 1343, Article 1, and by conspiracy to launder money of the violation of Chapter 18 of the United States Penal Code. From Article 1956 (h), Article 2 – specified by the Court.
The Superior Court statement does not indicate what will happen to the other 10 detainees, including a pregnant woman of Filipino origin.
At the hearing on September 30, his lawyers disputed the extradition request that came from America.
– We believe that it does not contain the prescribed form, nor the elements and data that any act of extradition must contain. First, we pleaded guilty to the request that came in, and then we insisted that it contained no evidence on the basis of which the extradition should be carried out – said then-lawyer Milan Petrović.
Let us remember that a group of young men and a pregnant woman, including citizens of Montenegro, the Philippines and Austria, all residing in Nis, were arrested at the end of July.
They are accused of the crime of fraud, which earned them 70 million dollars through the Internet. A Texas citizen was among those duped, so the American judiciary and the FBI intervened throughout the case, assisting in the arrest action.
The detainees are now threatened with extradition to the United States, where the entire process would take place, and according to the lawyers, their human rights would be in danger in America, and that is why the request is that they be tried in Serbia.
