Sentenced to four years for a serious accident, the families of the victims were outraged

In the first instance verdict, the High Court of Belgrade sentenced Nikola Mihailović to four years in prison for a road accident on the Ibar highway in August 2019, in which four young people died and four were seriously injured and slightly injured. The relatives of the victims, as they say, are outraged by such a low sentence and hope that the Prosecutor’s Office will present an appeal.

Driving with 1.36 per thousand alcohol in his blood, the driver of the BMW, Nikola Mihailović, 28, was traveling at a speed of at least 117 kilometers per hour, when he was on the Ibar highway, where the speed limit is 50 kilometers per hour, near Županjac. , take a taxi “dacia”.

Katarina Ivanković (20), Mihailović’s partner from “BMW”, and three from “Dacia”, Aleksandar Savatić (22), who was driving, Đordje Belušević (22) and Đordje Subotić (19), died in a terrible accident. The minor Stefan S, who was traveling on the “dacia”, was seriously injured, and on the “BMW”, Stefan Matović and Kristina Vasiljević avoided life-threatening injuries, while Stefan Ivanović was slightly injured.

For this serious act against road safety, the judges ordered Mihailović to spend four years behind bars. The relatives of the dead, crying, listened to the sentence and left the courtroom, insulting both the convicted person and the judges.

“Four lives, he took everything from us and then he’s four years old,” said the late Katarina Ivanković’s mother, Maja Ivanković.

“This is a failed state, the mafia …” said Marija Savatić, the mother of the late Aleksandar Savatić.

“I did not expect a greater punishment because we know that everyone is corrupt, especially the experts who denounced this,” said the victim’s brother.

The maximum penalty for a serious traffic safety offense is 12 years in prison. Attorneys for the victims’ families say that while Nikola Mihailovic spent his entire time in detention, a low sentence sends a bad message.

“When this detention is simple, he will be in prison for three years, and for his good behavior, he will be released in a year and a half,” said the representative of the families of the victims, Milena Stamatović.

The families and their legal representatives are very bitter about the experience of the experts of the Institute of the Faculty of Transportation. They say the speed was not even 117 kilometers per hour, Mihailović was driving even faster.

“That night when I came to the police in Belgrade to tell me that my son had died, the police officers with 30 years of experience told me that they had not had an accident where someone was driving faster,” said Marija Savatić, the mother of the late Aleksandar Savatić.

Traffic experts are especially reprimanded for not even going to the scene of the accident.

“The experience was made exclusively on the basis of video images from a store, and that’s just one shot,” says the lawyer for the victims’ family, Biljana Borovcanin.

The collision occurred when the “dacia” from the secondary road in the direction of Bogovađa joined the Ibar road, and the “BMW” collided directly from behind. The court took as a mitigating circumstance for the defendant the fact that the “dacia” did not stop and lost the BMW.

Those who stayed to fight for the truth on behalf of the victims say there was no salvation for them, as the “BMW” with the drunk driver was accelerating at almost immeasurable speed and caught up with another car without a single sign of braking.
