The Serbian Electric Power Industry has teamed up with state-owned institutions and public companies in Serbia in attacks against the SBB company, with the aim of obstructing their work and preventing access to services for hundreds of thousands of users, SBB announced.
After the expiration of the contract with SBB, Elektroprivreda Srbije filed a claim with the Commercial Court with a request for payment of € 1.18 million for the use of poles of the electricity distribution system in Belgrade, Kragujevac, Kraljevo, Nis and Novi Sad, as well as the removal of SBB’s cable facilities.
SBB, which has always paid regularly for the use of EPS equipment, has challenged the court’s jurisdiction to decide on the lawsuit until the relevant procedures are completed before the Administrative Court, RATEL and the Commission for the Protection of Competition, which presented .
In other words, EPS is the only one that has pillars, so SBB believes that by abusing its position, EPS is trying to impose unfair conditions by demanding greater compensation of 108% for each pillar in Belgrade, or 64% in the rest of Serbia, without giving any reason. for a huge price increase.
The prices requested are the highest in the region and much higher than in many European Union countries, indicating the intention to offer SBB an unfair and non-market contract, according to the statement.
“EPS actions are contrary to the basic principles of the Competition Protection Law and the Electronic Communications Law, so SBB addressed the Regulatory Agency for Electronic Communications and Postal Services (RATEL), as well as the Competition Protection Commission As an independent regulatory agency, RATEL is the only development of the electronic communications market and if there is no agreement between the two parties, the fee for the use of poles can only be determined in accordance with the provisions of the Article 51 of the Electronic Communications Law, “said SBB, adding that RATEL made a decision on the joint use of EPS infrastructure. which confirmed that SBB has a legal basis for the use of abutments.
However, RATEL did not determine the compensation for the costs of joint use, which is why SBB initiated a procedure before the Administrative Court, demanding that RATEL declare the amount of compensation in the repeated procedure, so that, as always, the company would pay all obligations under the law.
