RATEL has imposed a series of obligations on SBB and Telekom regarding the provision of access to other operators to its network.

SBB believes that Telekom controls key infrastructure and is a much stronger operator in the internet market, and that SBB should not even be subject to RATEL regulation. As an argument in favor of that attitude, SBB claims that they have less customer coverage, but add that RATEL ignored the large acquisitions that Telekom had in the previous period.

SBB’s lawyer stated that RATEL made an illegal decision and decided to ignore the optical infrastructure that Telekom Srbija is building and establish Telekom’s control over the network that does not allow access to other operators. Furthermore, RATEL is simultaneously trying to regulate SBB, which is a smaller operator in the market and essentially the only one representing such competition, the lawyer said.

“The court had an oral hearing today, we presented arguments, RATEL did not appear and we expect the court to annul RATEL’s decisions within a maximum period of 30 days and allow fair competition between state and private operators,” Smiljanic said.
