Zorica Avramovic, who twice sentenced Aleksandar Mitrovic to house arrest, appointed judge of the Belgrade High Court
The judge of the Criminal Chamber of the First Court of First Instance of Belgrade, Zorica Avramović, who carried out the proceedings against Aleksandar Mitrović, son of Pink TV owner Željko Mitrović, was promoted to magistrate of the Belgrade High Court.
This decision was made by the Higher Judicial Council at the session held on December 11, the first since the formation of the new Government of Serbia.
Judge Avramović is one of the nine judges who were elected from the basic courts of the Belgrade High Court in the last session of the HJC.
She was the center of public attention as an acting judge in the proceedings against Aleksandar Mitrović due to a serious act against road safety and lack of assistance to a person injured in a traffic accident.
It should be remembered that in July 2013, Mitrović, driving above the permitted speed, hit a car and killed the minor Andrea Bojanić.
In July 2019, Mitrović was sentenced in the first instance to 11 months in prison for a serious act against road safety and another six months for failure to provide assistance.
Judge Avramović imposed a single sentence of 12 months of house arrest, twice less than the one requested by the prosecution.
Mitrovic was also banned from using the car for a year.
The part of the verdict relating to the serious act against road safety was overturned by the Court of Appeals in January this year.
As indicated in the judgment, the first instance verdict contained significant violations of the provisions of the criminal procedure, considering that the determining facts that are the object of evidence were not motivated, and those that occurred are contradictory.
The Appeals Court also noted that, in addition to numerous expert reports, it was unclear how fast Mitrovic was moving.
As for the part of the first instance sentence related to the crime of lack of assistance to the injured party, it was modified due to absolute obsolescence.
In other words, the maximum penalty for this crime is three years in prison, so in July 2019 it became obsolete.
In October this year, Judge Avramovic again sentenced Aleksandar Mitrovic to 11 months of house arrest for a serious offense against road safety, as well as a one-year driving ban, which takes effect after serving a sentence from prison.
A final verdict is still pending.
