While the insured in Serbia, according to the Law on Pensions and Disability Insurance, is entitled to only one pension, either personal or family, abroad they can exercise the right to two pensions: personal and family.

However, for example, in the Netherlands and Switzerland, the right to a personal and family pension is exercised under special conditions.

That was the reason why a Serbian civil engineer working all over the world decided to pay for his internship in his country, even though he currently works in Holland. That is, you plan to return to Serbia and want to receive part of your pension in your own country.

As he states in his letter to our newspaper, he worked for more than 15 years in England, where his boss paid for his insurance, and after his employment ended, he continued to contribute for his internship. After that, he got a job in the Czech Republic, where his Czech employer also paid contributions to the PIO. You have been working in the Netherlands for the last three years, where you are legally registered, but according to article 15 of the Pension and Disability Insurance Act, you would also like to start paying for your internship in Serbia.

He says he doesn’t understand why this is a problem. At the same time, it does not even occur to him that some time of service for which he was paid contributions around the world could fail, although there were overlaps, that is, at the same time he was taken to work in two countries.

When asked who is entitled to the payment of contributions under article 15 of the Pension and Disability Insurance Law, the Pension and Disability Insurance Fund responds that the insured can join the compulsory insurance under article 2 of this law only if you are not insured for other reasons (employment, self-employment, agricultural activities).

The insurance under article 15 ceases if the compulsory pension and disability insurance is taken out on another basis.

This also applies to insured persons in the country with which the social insurance contract has been concluded. The insurance period according to article 15 of the law can only be determined if it does not overlap with insurance with a foreign insurance company, they explain in the PIO fund.

Therefore, the insured cannot work in England and the Netherlands at the same time and pay contributions in Serbia and receive a Serbian pension tomorrow.

When it comes to the independent payment of contributions, it refers only to people outside the compulsory insurance who, through the independent payment of contributions, realize tomorrow the right to a seniority pension, and there are about 19,000 of them in Serbia at the moment .

As provided by law, when applying for insurance, the person who joins chooses one of the 13 insurance bases offered on which they will pay the contribution, regardless of their education. The lowest base is 35 percent of the average salary in Serbia earned in the previous 12 months, as of September of the year prior to the year for which contributions are paid.

The contribution is paid at a rate of 25.5 percent on a selected basis. In 2020, the lowest base is 25,801 dinars, and the highest base for this year is 368,590 dinars.

This means that the monthly contribution payment in the current year on the lowest basis is 6,579.26 dinars and on the highest basis the monthly obligation is 93,990.45 dinars.

The length of service can be paid by those who do not retire, but also by those who have never worked. The condition is that they are older than 15 years.
