Zora Dobricanin Nikodinovic, defense attorney for Predrag Koluvija and Vladan Zivojinovic, who are accused of participating in the production of cannabis on the farm “Jovanjica” with eight other defendants, challenged the accusation of the Organized Crime Prosecutor’s Office during her introductory speech Yesterday. He claimed that 1.6 tons of cannabis were not found on the plantation, but industrial hemp.
She “spent” most of her presentation, explaining that most of the facts with which, as she said, the prosecution wants to prove the guilt of the defendants, were not collected legally. He challenged the search warrant for the restaurant “Jovanjica”, one of the three places where the search was carried out during the investigation, stating that this document was never delivered to the first defendant, Koluvija, and that the prosecution’s claim that it was a user of the aforementioned catering service is incorrect.
– I wonder who came up with everything. I suggest that the court, as a witness, hear from the previous procedural judge who signed this order, said Dobričanin Nikodinović, addressing the court panel.
As evidence, he also challenged that with which the prosecution wants to show that the family home of the defendant Stevan Holić is the place where the crime was committed.
– Holić was not present when his house was searched. I wonder why it is so? How much is this evidence being manipulated? I don’t know what to say – declared Dobricanin Nikodinović.
– Why do you speak of the defendant Holić and expose the evidence related to him? asked Judge Zoran Ganić.
– The prosecutor alleges that it is an organized criminal group, formed by Koluvija, so I will also reach my client – replied the lawyer.
He also claimed that the prosecution did not say who, when, how, dried, cut and packaged the cannabis found in “Jovanjica.” He also said that in that farm, each plant had an individual declaration and its own barcode, a kind of “identity card.” He reiterated that the police withdrew this evidence during the seizure, which broke the chain of evidence and lost track of the plants.
Dobricanin Nikodinovic also “dedicated” part of his presentation to the National Center for Criminal Forensic Medicine of the Ministry of the Interior of Serbia, an institution that determined from experience that the plants found in the “Jovanjica” plantation were the drug cannabis, with a significantly higher proportion of psychoactive substances than allowed. This expertise, he repeated, was preceded by several illegal actions, which compromised all his findings, as well as the resulting evidence.
