The suit will be filed on behalf of a military man from the capital, who resided in Kosovo in 1999 and later contracted cancer as a result of the depleted uranium bombardment.
NATO will sue for violating the right to life, due to the use of ammunition with dangerous charges. Similar lawsuits will be filed in the courts of Novi Sad, Kragujevac, Nis and Vranje later this month.
According to Aleksic, the lawsuits will be initially filed on behalf of people who found themselves in the same legal situation as the Italian soldiers, who received procedures before the local justice: they were in the target area without proper protective equipment, ate contaminated food and drank water . , used dusty roads and inhaled noxious particles. Only later will lawsuits be initiated on behalf of civilians living in Kosovo and Metohija, Vranje, Bujanovac and Presevo at the time of the NATO bombing.
– Colleague Tartalj demonstrated in the Italian courts the presence of heavy metals in the sick soldiers who were in Kosovo and Metohija, as a result of the bombardment with depleted uranium. It causes lung, bone, brain, and leukemia cancer. We will present to the court more than 70 Italian verdicts and more than 180 pieces of evidence, expertise, the results of the investigation carried out by the Italian commission, the confirmation of the World Health Organization investigating cancer on the relationship of cause and effect between cancer and heavy metals. – explains Aleksić.
There are also two judgments of the Strasbourg Court against the United Kingdom and Turkey, where the connection between exposure to depleted uranium and cancer has been demonstrated. The evidence is also the results of the investigation of the UN Commission on Environmental Protection, as well as the 2000 verdict of the Belgrade District Court, which sentenced NATO leaders to 20 years each. It was abolished, but they were not legally released, so the case is not out of date.
– It is possible to file a claim against NATO, because it has the status of a legal person. We will ask for compensation for the sick and we hope it will not be less than in Italy, where it amounted to 700,000 to one million euros per person – says Aleksić.
TAXES
The REPRESENTATIVES of the injured parties will request exemption from payment of court fees, since they are astronomical for the value of the dispute. In the first instance procedure, it would be around 1,000 euros, and in the appeal procedure, double, which would prevent the injured parties from accessing justice.
