I kicked him in the head while he was lying – this is how Nikola Bojović and Mitar Pandurević defended themselves at trial for hitting Stefan Filić

I do not wish anyone so much pain, that it will not pass while we are alive – said Ljubinka Filić, mother of Stefan Filić, after those accused of the murder of her son, Nikola Bojović (20) and Mitar Pandurević (20) presented his defense before the Smederevo High Court.

They pleaded not guilty and denied allegations that they beat a young man in Velika Plana, who died from his injuries a day later.

The indictment accuses Bojović and Pandurević of killing Filić together on February 2 in front of the “Brodolom” nightclub in Velika Plana, during reckless violent behavior. According to the indictment, Bojović and Pandurević, who were under the influence of alcohol at 1.7 and 1.35 per thousand respectively, punched Filić in the head several times. The young man fell and, while lying unconscious, Bojović kicked him in the head.

Stefan died 30 hours later, and an autopsy and forensic examination of the injuries established that “the death was the result of devastating and violent injuries to the brain centers and a cerebral hemorrhage.”

In his defense, the first defendant Nikola Bojović denied the allegations in the accusation that he hit Filić several times on the head, claiming that there was actually a fight between two groups of boys.

– One of the young men from Stefan’s group laughed and threw it at us, I don’t remember what. I hit him with a “slap” expecting an apology … He started a commotion, then they hit me on the nose, I don’t know when. Then, with peripheral vision, I noticed the young man was falling face down to the ground … then I found out it was Stefan. While he was lying down and was not moving, I kicked him in the head, out of fear, because he had already received a blow – said Bojović.

STEFAN FILIĆ FOUNDATION

In a DECLARATION to the court, the late Stefan’s father, Nenad Filić, said that “no money can return his son, but they will keep the claim for compensation.”

– All the money, if any, will be used for the establishment of a humanitarian foundation for the fight against peer violence, which will be named after our son – said Nenad Filić.

The continuation of the main trial is scheduled for November 23, when the brother of the deceased, Andrija Filić (16), as well as the minor MR will be examined as witnesses.

The defendant Pandurević stated that he did not hit the late Filić. He claims that Stefan’s brother Andrija beat Bojović, after which he intervened and exchanged several blows with him. Pandurevic also claims that Stefan exchanged blows with Predrag Stoiljković, meaning that Stefan hit him once and Stoiljiković hit him several times. He also said he saw “Stefan shaking and then falling”.

Bojović and Pandurević claim that they did not know Filić, that they had not had a conflict before and that they did not come to see what was happening to the young man who was lying motionless on the ground. They fled as soon as they heard the police sirens.

The defense lawyers of the accused youth, who are accused by the Prosecutor’s Office of aggravated murder in complicity, where a penalty of at least ten years to life imprisonment is threatened, dispute the classification of the crime.

In addition to Stefan Filić’s parents and brother, family and friends were in the courtroom. They came to court with balloons, T-shirts with Stefan’s face, and banners with the words “Justice for Stefan”, but were not allowed to bring them to court.
