Marjan Vujacic, accused of killing Milo Ilic and Veselin Kalzeic, was not extradited to Montenegro from Serbia because there were no conditions for that, it was said at yesterday’s trial in the Podgorica High Court. The defense attorney for Rade Popovic, his alleged accomplice, demanded that his arrest be lifted.

This was announced yesterday by the president of the Extrajudicial Chamber of the High Court, Judge Boris Savić, at the beginning of the hearing on the justification and legality of the accusation against Vujačić and Rado Popović, accused of helping before and after the crimes committed. ..

Special counsel Stojanka Radovic said she stuck with the allegations in the indictment and suggested that the court confirm it.

Defendant Vujačić’s defense attorney, attorney Ognjen Radić, states that the factual description of the accusation is not fully supported by the evidence.

– Given that we are in the phase of control and confirmation of the accusation, according to the defense, the first problem is the impossibility for the defendant Vujacic to appear at the hearing, and when his known address is known, it is available. This may not be of much importance at this time, but in subsequent court proceedings the defendant has his rights, if he is present at the trial. As for the legal qualification established in the indictment, it is not possible to speak of the creation of a criminal organization – said Radić.

Attorney Miloš Vuksanović, Rada Popović’s defense attorney, had several objections to the evidence proposed with the indictment and legal qualification. Popovic demanded that his detention, which he had been in for 11 months, be lifted.

His defense attorney stated that the accusation was completely illegal and contrary to the provisions of the Criminal Procedure Code (CPC).

– It is contrary to the provisions of the CPC that give the concept and definition of organized crime. Rade Popović is accused of committing a crime – the creation of a criminal organization, which was created in 2017, consisting of three or more people, and which agreed to act under the orders and instructions of the organizers and to provide other assistance when committing crimes. However, other members, including the organizer, have not been identified, are unknown and apparently do not exist. The fact is that even after almost a year from the start of the investigation, the Special State Prosecutor’s Office did not provide evidence of the existence of a criminal organization, Vuksanović said.

He added that Popović’s specific role was specified very flatly.

– The test boils down to listing the communication with the defendant Vujacic, with whom he remained on friendly terms, and supposedly connecting him with a car rental agency, which are the most common life activities of every living human being in operation daily and do not represent anything incriminating. I suggest that the High Court take a decision at this stage of the procedure, that due to the lack of evidence that the defendant Rade Popović is a reasonably suspect, suspend this criminal procedure – stated Vuksanović.

According to SDT documents, Popovic helped procure two vehicles used in the murders of Kalezic and Ilic, committed in October 2018 and April 2019, respectively.

After his arrest, Popovic denied having committed the criminal act charged against him.

Shortly after, his mother, Sonja Popovic, approached “Vijesti”, alleging that the Special Prosecutor’s Office offered her son to be an associate witness in the process against a criminal clan, offering in exchange to leave Montenegro with a new identity and material care.

– From everything that the inspectors of the Special Department affirmed, the only certain thing is that Rade Popović knows Marijan Vujačić, who were friends, they had a joint venture in the last two years … We point out to everyone that with this act they put in danger directly the safety of him and his family among other things in his reaction at that time.

There’s more, and the motive is blood money

Chief Special Prosecutor Milivoje Katnić said in October 2019 that Vujačić and Popović were not close to any of the Montenegrin criminal clans at war, Skaljarski or Kavački, but were instead members of a special criminal organization.
