Some 1,500 heirs to assets confiscated after World War II could expect to pay compensation that does not exceed 1,000 euros, according to the Restitution Agency.

That is not the final number and it will surely be higher, because the Agency brings new compensation decisions every day.

Ivana Zivkovic from the Restitution Agency tells Tanjug that compensation amounts that do not exceed 1,000 euros will be paid in cash, in full in 2022.

He explained that this is the most significant change in the Law of Return of Confiscated Assets and Indemnification.

The modifications specify that for restitution beneficiaries who, based on a final decision on compensation, are entitled to compensation that does not exceed the amount of 1,000 euros and is made exclusively in cash, paying the entire amount, on March 31 next year compared to the year a government law came into force.

“All applicants whose final decisions of the Restitution Agency have determined the amount of compensation up to 1,000 euros, will receive that amount in cash, and not in bonds, as planned until now,” said Zivkovic.

He said that the Agency makes decisions on compensation on a daily basis, and that they become final 15 days after the day of their adoption, if there is no appeal against said decision.

“The number will certainly increase every day, because decisions are made every day and become final every day. Once the decision is final and after the approval of the amendments to the law, some 1,500 people could receive compensation. complete in 2022 if up to 1,000 euros according to the applicant “, explains Živković.

He specified that, if there are several applicants in a decision, that is, several legal heirs of the former owner, and if an amount of up to 1,000 euros is determined for each of them, they will all receive that amount in cash.

The compensation bonds should also be issued in 2022, and Zivkovic says the government should first determine the compensation ratio.

He explained that it is actually a percentage that is multiplied by the amount of compensation and on the basis of which the exact amount of compensation that the beneficiary of the restitution will receive is determined.

He also stated that after the decision determining the exact amount of compensation is final, a law of the Government of Serbia will be passed which will determine the total number of decisions and the total amount of compensation.

“For all the decisions that would be final by June 30 of the current year, a government law would be approved before September 30 of the same year, which would determine the amount of compensation and emissions and how to issue the bonds “Zivkovic explained.

I would add that then next year, in relation to that government law, bonds would be paid for a period of 12 years.

According to Zivkovic, the bonds will be paid to those over the age of 70 over a period of five years, and the amount of the bail will be paid to people over the age of 65 for a period of 10 years.

He recalled that a total of more than 75,000 requests for the return of assets were submitted to the Restitution Agency and that, to date, the Agency has made more than 3,000 decisions on the right to compensation.

However, it explains that decisions can be made to compensate those applicants who have had real property returned in kind.

“And in those decisions, decisions can be made about the right to compensation, if there is any real property that cannot be returned in its natural form,” Zivkovic said.
