It is sad that we live in a country where a man, who is guilty of the death of four young people, our children, received only four years in prison.

Thus, for “Novosti”, Gordana Belusevic, the mother of the late George (22), comments on the verdict against Nikola Mihailovic, who was convicted the day before yesterday for a first instance verdict for a car accident on the Ibar road in August last year when his son Djordje Subotic (19), George Belusevic (22), Aleksandar Savatic (22) and Katarina Ivankovic (20). Then, Mihailović collided with a “dacia” driven by Savatić at high speed with his “BMW” car. Stefan Stevanović, Kristina Vasiljević and Stefan Matović were seriously injured in that accident and Stefan Ivanović was slightly injured.

– The traffic experts were experts from the armchair, they did not go to the scene of the accident at all and everything they said was in favor of the accused – Gordana tells us. – I would ask them if they would also be experts if they were in our place and if their children were killed. That Mihailović cut them at high speed, he himself admitted that he had previously drunk 12 beers, and everything was presented as if it really did not matter.

The family of the late Đorđe Subotić was also shocked and disappointed by the sentence imposed on Mihailović. The parents did not have the strength to speak to the media. His sister Alexandra told us that they expected a stricter penalty:

– We are depressed and defeated. My brother will not recover even the maximum sentence of 12 years, but it hurts the injustice that the culprit of his death received only four years in prison. It took a lot from us. Four families were destroyed and forced to live in great pain and emptiness due to their arrogance and irresponsibility. He drove drunk and got out, he wasn’t punished to the extent he should None of the victims’ relatives heard or felt their alleged remorse.

BILJANA Borovčanin points out that the expertise that was carried out on the basis of the logs and video surveillance footage of the local store cannot and should not be the only evidence on which the court bases its decision.

– It was said that 117.6 kilometers per hour was the slowest speed at which the accused was moving. And how big was it then when there are no traces of braking? With the rejection of the additional experience by the court, many things were left unclear and incomplete.

Aleksandra also tells us that her brother from her uncle Stefan Stevanović, who was inseparable from George, and fortunately survived that terrible accident that night, continues to feel the serious consequences of that accident.

– He was in a coma for a month, received severe head and brain injuries. It took him a month to talk and six months to walk. He is still pulling his left leg. He has great memory problems, sometimes in 15 minutes he forgets what we were talking about. That worries us all. Then, when you see what one of my brothers is struggling with and that I don’t have another brother, and on the other hand, the culprit is punished like this, we are sick.

THE COURT DEPENDS ON EXPERTS

LAWYER Gordana Božilović, who used to work as a judge, says that when it comes to traffic accidents, experience plays a key role, saying precisely and concretely how much the defendant contributed to causing the accident:

– The court is primarily guided by its conclusions. The expert gives a factual description and the court has “hands tied.” Experts indicate the shortcomings of both parties, if any. If the court accepts that expertise, it must evaluate the judgment based on it. It is difficult to generalize, because each case is specific and there is the belief of a free judge that he himself can evaluate the amount of the sentence. The defendants in such situations are mostly people who have not been convicted before, so this is an extenuating circumstance for them.

Lawyer Biljana Borovčanin, representative of the three injured families Ivanković, Belušević and Savatić, tells us that the verdict against Mihailović is more than shameful:

– It is humiliating, considering that it is prescribed for a maximum of 12 years. We hope that the Appeal will have more hearing for such a serious commission of a felony, as well as for all the circumstances relating to the high degree of guilt of the accused. After the panel explained the verdict, the sentence was a reward for the accused. Nothing can bring victims back to life, but the message going forward to all participants in trafficking should have been a little more serious. Justice is not satisfied here, and such a low punishment only gives the wind in the rear of the young man to drive an unrestricted vehicle in the future without thinking, under the influence of alcohol.
