In other words, the proposed amendments to the Budget System Law granted users of public funds the freedom to receive employees for an indefinite period of time and for a defined period of time as apprentices, without special permits and consents.

Finance Minister Siniša Mali recently explained that new employment in the public sector will no longer be decided by the government commission, but by the institutions themselves, according to their needs and possibilities.

However, this will be limited so that institutions can employ up to 70 percent of the number of employees who left that institution during the previous year.

The Commission will continue deciding on the admission of new employees for an indefinite time and for a defined time as interns above this percentage, at the proposal of the competent body and with the opinion previously obtained from the Ministry of Finance.

“There was employment control in the public sector and, according to the IMF, our desire was not to loosen the strict control system but to regulate it in some way, so not all new employees should go to the employment commission of the Government of Serbia to obtain consent to transfer responsibility to the institutions and institutions they employ, “Mali told Tanjug at the time.

Thus, he added, as of January 1 they will have the opportunity and freedom to employ if they need it in accordance with their business plans and the salary fund they can contribute. It indicates that with the aforementioned limit of 70%, indirect control will be maintained again, but the institutions will have the opportunity to hire people according to their needs.

From January 1, 2021 to December 31, 2023, temporary and permanent employment in the public sector will be facilitated, after the prohibition of employment in that sector was in force for six years.

The total number of temporary employees cannot exceed 10 percent of the total number of permanent employees, except with the consent of the Government of Serbia.

Likewise, the bill establishes that employment will be possible if the company or state institution has secured funds for salaries, that is, salaries, with taxes and contributions for new employees, as well as under the conditions and in accordance with the established procedures. by special regulations.

When no restrictions apply

No restrictions apply to judges, prosecutors and deputy prosecutors, teaching staff of an institution of higher education, and scientific and research staff of an accredited scientific research organization in accordance with the law.

Likewise, they do not refer to persons designated and appointed in state bodies and bodies of territorial autonomy and local self-government units, as well as directors of public companies, capital companies, institutions and public bodies founded by the Republic or units of territorial autonomy, that is, local self-government.

The restrictions do not apply to people with disabilities according to the regulations governing the field of vocational rehabilitation and employment of people with disabilities.
