Minister Dias Toffoli, president of the Federal Supreme Court (STF), determined that the Superior Court of Justice (STJ) present information on the removal of Wilson Witzel from the post of governor of Rio de Janeiro. The deadline is 24 hours. Based on the STJ’s response, the Attorney General’s Office will also be heard.

The removal was determined last Friday (28) by Minister Benedito Gonçalves, of the Superior Court of Justice, who responded to a request from the PGR. The case of the outgoing governor will be analyzed by the Special Court of the court on Wednesday (2).

Toffoli is the rapporteur for the appeal presented by Witzel’s defense to the STF.

In the document sent to the court, the lawyers questioned whether the removal of an elected governor could be determined individually by a minister or whether it needed the approval of the Special Court of the STJ. They also questioned whether the measure could only be taken after receiving the complaint.

Witzel’s absence is valid for 180 days and was determined at the request of the PGR in Operation Tris In Idem, which investigates irregularities and deviations in health.

The governor denies having committed any crime and “contested” on Friday that the investigations present evidence against him.

The precautionary measure aimed to curb his alleged leadership over the criminal organization that promoted diversion of health resources in the state and also the impacts of “criminal engineering” on the public coffers of Rio de Janeiro.

The PGR even requested the arrest of the governor, but the request was denied by the STJ, which understood that the removal is enough to try to stop the criminal actions.

Witzel was also reported to the STJ by the Public Ministry. The case will be analyzed by the Special Court of the court next Wednesday (2).

Minister Benedito prohibited Witzel’s access to state government facilities and his communication with officials, in addition to the use of services.
