Thousands of policyholders will receive payments owed by the INSS in 2021

The National Institute of Social Security (INSS) will pay billions, in total, to thousands of Social Security policyholders, in 2021. In addition to the precautions reserved for those who won the right in court, there is the penultimate batch of payments for review benefit differences such as death pension, social security sickness benefit, and disability retirement.

This payment refers to differences arising from the review of benefits related to the interpretation of subsection II of article 29 of Law 8,213 of 1991, which deals with the formula for calculating monthly income.

The revision is part of the agreement established in August 2012, between the INSS, the Federal Public Ministry and the National Union of Retirees and Pensioners of the Força Sindical, approved by the Federal Court of São Paulo, by public civil action. This agreement covers the reprocessing of benefits paid by the institute and granted from 2002 to 2009.

At that time, these benefits had been calculated based on 100% of the insured’s contribution salary. With the agreement, the average began to consider only 80% of the largest contributions. And arrears are repaid in annual installments, since 2013, in May of each year. In 2022 the last batch will be paid.

The benefits are pension for death, sickness benefit, disability retirement, accident benefit, sickness benefit due to work accident, disability retirement due to work accident, accident benefit and death benefit due to work accident.

According to the INSS, for each annual batch of article 29 revision, the amount of arrears of more than R $ 615.53 million is committed. 1,473,703 benefits are expected to be paid in 2021.
