The Federal Supreme Court is analyzing a bill that proposes an increase in the benefit of retirees from the National Institute of Social Security (INSS) that depend on the permanent help of third parties. The idea is to expand the value additional 25%, it applies only in some cases, to more insured persons in the municipality.
Currently, only disability retirees are entitled to the benefit. But if the project is approved, the extra contribution will be for the entire category, as long as the link with the caregiver in daily need is demonstrated.
As it involves a large number of insured, Minister Luiz Fux, rapporteur for the project in court, reported that the proposal must follow the rite of general repercussion. Thus, everything defined by the STF ministers will be applied in all legal actions on the subject.

Since last year, there has been this discussion about the additional 25% for retirees who depend on permanent caregivers. The first class of the STF had already suspended the advance of the shares proposing the increase. The justification given by the ministers is that the project would have an impact of R $ 7.15 billion annually on public accounts.
This year the extension of the surcharge was discussed again, but now by the Superior Court of Justice (STJ), which approved the project. The STJ defended the initiative alleging that the pension premium is of an assistance nature.
However, the INSS stated that the STJ’s decision violates the principles of equality, since the disabled retiree faces disability during the work period and in other cases not. The date of the new STF trial remains undefined.
