SP court orders former doctor to return to prison

The São Paulo court ruled today that former doctor Roger Abdelmassih must return to prison. Adbelmassih has received home care since April this year due to the new coronavirus pandemic; he was at home because he was considered a risk group both because of his age of 76 and because he faced health problems. He is sentenced to more than 173 years in prison for the rape of 56 patients.

The decision, signed by judge José Raul Gavião de Almeida, responds to an appeal from the São Paulo Public Ministry. Almeida maintains that serving the sentence at home is “a privilege restricted to the beneficiaries of the open regime” and that the case does not apply to the former doctor.

The magistrate assures that the heart problem experienced by the ex-doctor “is the same for anyone who suffers from a heart disease of this nature, inside or outside the prison system” and that other health problems raised by the defense can be treated within the prison unit. Still, he adds that the official doctor did not recommend that he not be treated in prison.

HE Twitter contacted Abdelmassih’s lawyer, but did not return until the publication of this text.

Until April of this year, he was serving a sentence at the Dr. José Augusto César Salgado Penitentiary, in Tremembé. The former doctor has had his house arrest challenged and revoked more than once.
