The Attorney General’s Office (PGR) sent a statement to the Superior Court of Justice (STJ) on Tuesday (1st) in which it said that it remains “convinced” of the need to arrest the governor from outside Rio, Wilson Witzel. The PGR also said it should file a new complaint against Witzel.
The PGR sent the document to the ministers that make up the Specialized Court of the STJ, who must analyze this Wednesday (2) if Witzel remains out of office. The Special Court is made up of the 15 oldest ministers of the Court.
Witzel’s absence is valid for 180 days and was determined by the STJ, at the request of the PGR, in Operation Tris In Idem, which investigates irregularities and deviations in health resources in Rio de Janeiro. Witzel denies the charges.
When the PGR requested the removal of Witzel, it also requested the governor’s arrest, which was denied by STJ Minister Benedito Gonçalves.
Earlier on Tuesday, Witzel’s defense asked the Federal Supreme Court (STF) to suspend the trial scheduled for Wednesday at the STJ.

According to the Prosecutor’s Office, Witzel has structured a criminal organization since he assumed the government of the state of Rio. The PGR says that the events are not only current but are occurring and revealing “special gravity and reprehensibility.”
“Although the Federal Public Ministry remains convinced of the need for the preventive detention of Wilson Witzel, it still understands that the e. Minister Benedito Gonçalves, in a calm and thoughtful reflection, in a well-founded decision, legitimately chose to give the governor a final decision opportunity, ”wrote the PGR.
The PGR says it should file a criminal organization complaint against Witzel in the coming weeks.
“Given the complexity of the facts and the investigation, new criminal actions will be triggered, adding that in the next few days a complaint will be offered for the exercise of the crime of constitution and belonging to a criminal organization, in accordance with the provisions of Law No. 12,850 / 2013 “, reported the Organ.
When he was removed from office on Friday, Witzel, his wife Helena and seven others were charged with crimes of corruption and money laundering.
The Prosecutor’s Office affirms that they received R $ 554 thousand in bribes from an alleged scheme of embezzlement of funds to face the pandemic.
