President Jair Bolsonaro complained and even suggested resigning Sergio Moro due to the opinion of the then minister in relation to the detention of people who breached the sanitary isolation rules due to the coronavirus pandemic.

The message, dated April 12 of this year, was sent by the president to the then minister after the publication of a report that recorded the opinion given by Moro in a videoconference.

The text appears in the documents attached to the investigation of the Federal Police investigating the alleged interference of the President of the Republic in the Federal Police.

The opening of the investigation was authorized at the end of April by Minister Celso de Mello, of the STF, after a complaint from the former Minister of Justice Sergio Moro. This Wednesday, the PF requested the extension of the investigation.

On April 12, a Sunday, the daily “Valor Econômico” reported Moro’s participation in a videoconference of an investment company.

In this videoconference, the minister explained that the ordinance that deals with the health emergency related to the new coronavirus would allow the police to act even in a coercive way to comply with the regulations.

President Jair Bolsonaro has always criticized the possibility of jailing people who did not obey the measures.

About an hour after the report was released, Bolsonaro sent a link to the minister. And he said: “If this is true: all the ministers, if they want (sic) to contradict the PR, they can do so, but have the dignity to resign. – Open to the press.”

Five minutes later, Moro replied. “What exists is (sic) art 268 of the PC. I did not speak to the press.

Article 268 of the Penal Code defines the crime of infringement of a sanitary measure, which consists of “violating the determination of the public power, aimed at preventing the introduction or spread of contagious diseases.” The crime is punishable by up to one year in prison and a fine, which can be aggravated if the offender is a health professional.

The message is quoted by the Federal Police in an analysis report of the material seized in the investigation: the messages from the cell phone of former minister Sérgio Moro were analyzed by the investigators.

The report says that “only passages considered relevant to the context of the investigation would be highlighted.”

However, the relationship between this message and the investigation of possible interference by the President of the Republic in the Federal Police is not evaluated.
