Justice reclassifies the case of a cyclist run over and a driver can go to a popular jury for intentional homicide

The Justice of São Paulo accepted the request of the Public Ministry and reclassified on Wednesday (25) the investigation that investigates the trampling of the cyclist Marina Kohler Harkot, 28 years, as intentional homicide for possible fraud (when the risk of death is assumed). With the change, the driver José Maria da Costa Júnior, 34, who ran over and killed Marina in the last 8 days can go to a popular jury.

The Civil Police had charged Costa Júnior with involuntary homicide in the direction of a motor vehicle and fleeing the scene of the accident without providing assistance to the victim, on the 10th, when he turned himself in to the police.

According to the investigation of the case, he was driving under the influence of alcohol and at high speed, as evidenced by the videos of the security cameras and the statements of the witnesses. The police investigation of the case concluded on Tuesday (24).

With Wednesday’s decision, the case was referred to a specialized court of the Jury Court, where intentional crimes against life are tried.

Another prosecutor and another judge will analyze the investigation and, depending on their decision, the driver may go to a popular trial for having run over and murdered the activist cyclist. For now, respond to the process in freedom.

In addition to Costa Júnior, two other people who were in the car at the time of the accident were also held responsible by the police. The student Isabela Serafim and the notarial secretary Guilherme Dias da Mota, both 21, were accused of not helping and can also go to the Jury Court for the fact that the crime is related to an intentional homicide.
