A court order issued by 2nd Cvel Court of the Nova Lima District, in Grande BH, authorized, as of this Wednesday (12/16), bars and restaurants in the municipality to receive customers for the consumption of alcoholic drinks respective locations. The action was moved by Brazilian Association of Bars and Restaurants (Abrasel-MG) and the decision applies only to the affiliated entity.

On December 7, the Nova Lima City Council put into effect a decree that prohibited the consumption of alcoholic beverages in bars, restaurants and the like, as in Belo Horizonte. The measure, according to the municipal executive, was to try to control the acceleration of COVID-19 in the city.
Despite this, the judge Maria Juliana Albergaria Costa, who signed the preliminary resolution, understood that “an avalanche of municipal decrees ended up generating a greater demand for the Judicial Power”, highlighting the number of ordinances issued by the city and the refusal of the city to participate in the Conscious Mines program, government of Minas. In this way, the magistrate saw “arbitrariness” the municipality to publish the decree that came into force on the 7th.

“In this sense, the decree that is now being challenged is contradictory to so many previous ones and, at first glance, with an air of arbitrariness,” he published.

Another point highlighted by Judge María Juliana was the fact that the city is “fully operational in public and private areas”, so the city is not in a position to delegate to COVID-19 the greater proliferation of bars, restaurants and Similar. He also added that the issue does not have to be stopped in Justice, since the city has the power to inspect crowded places.

“It should be emphasized that there would be no need to take this matter to the Judiciary, since, with a simple act of the manager, exercised through the police power, which is the control to close or allow the operation of establishments or prevent crowds to guarantee health the public would satisfy the search for the greater good ”, he argued.

The Municipality of Nova Lima was contacted by State of Minasbut has yet to comment on the decision.

Abrasel asks for respect for the protocols

Moments after the publication of the preliminary decision, the president of Abrasel-MG, Matheus danielHe used the entity’s Instagram to speak. Matheus asked for collaboration with bars and restaurants, as well as with customers, regarding protocols, such as distancing tables and people, avoiding the formation of crowds.

“The sale of alcoholic beverages, following all protocols and respecting all times, is free from now on. I ask all members to strictly adhere to the protocols. We are not going to give this a chance to fall, we have to do our part. I wish good sales to all the associates in Nova Lima and I comply with the protocols. I take advantage of and ask the population that frequents the bars and restaurants of Nova Lima: collaborate, follow the protocols, follow the guidelines of the owners of the establishments ”, said Matheus.
