Insured persons can apply for sickness benefit in two ways

Insured by the National Institute of Social Security (INSS) they now have two options for claiming sickness benefits: schedule the medical experience to grant the benefit in one of the INSS agencies that are conducting tests; or choose to anticipate the benefit over the Internet.

Both alternatives were endorsed by Joint Ordinance 62, of the Special Secretariat of Labor and Social Welfare and the INSS, published this Tuesday 29 in the Official Gazette of the Federation. However, it should be mentioned that the anticipation of the sickness benefit, in the amount of a minimum salary (R $ 1,045, in 2020), can only be requested until October 31.

Also, it is important to note that the requirement to schedule medical expertise and the anticipation requirement are mutually exclusive. However, there will be no loss for the insured who has already requested the advance, in case of subsequent scheduling of medical expertise.

“The insured who chooses the advance will be notified later by the INSS to schedule the medical examination for the definitive granting of the benefit and the payment of the difference owed, if he is entitled to an amount greater than R $ 1,045”, explained the INSS.

Advance sickness benefit

The anticipation of temporary disability aid was adopted in April of this year, and can be requested until October 31. However, the benefit can be paid until December 31. In the case of sickness benefit, the anticipation is R $ 1,045. If the insured is entitled to a higher amount, the difference will be paid later.

It is also worth mentioning that with the new ordinance, all policyholders will be able to choose anticipation, and not just those who live more than 70 kilometers from an agency that offers medical experience. Whoever opts for the advance must attach the medical certificate to the request made through the website or the “Meu INSS” request.

The document must meet the following requirements: be legible and without erasures; contain the signature of the issuing professional and identification stamp, with the inscription of the respective Class Council or Unique Registry of the Ministry of Health (RMS); have information about the disease or the International Code of Diseases (ICD); and indicate the estimated required rest period.

As of 2021, what is the situation of those who requested the anticipation?

After December 31, when the advances of the sickness benefits are interrupted with the end of the state of public calamity, the INSS will credit the accumulated difference owed. This is what appears in Ordinance 932, published in the Official Gazette of the Federation on September 17. See what happens in each situation:

  • If the benefit is transformed into another type of INSS payment, the advance must be canceled and what was paid in advance will be deducted from the new amount paid;
  • If early help is denied during a pandemic after receiving medical experience at an agency, it will be suspended. In this case, it will not be necessary to return the advance;
  • If the insured voluntarily returns to work, the INSS will also stop anticipating sickness benefits. Scheduled payments will be blocked.

It is worth mentioning that the advance will be paid according to the time of absence indicated in the medical certificate sent online. If there is a need for an extension, it is necessary to apply within the last 15 days of the advance already granted.
