The Minister of the Federal Supreme Court (STF), Gilmar Mendes, determined that an investigation against Senator José Serra, of the PSDB, be removed from the first-degree Electoral Justice and referred to the Supreme Court.
In the office, Gilmar affirms that the order is valid for this process and “everything correlates.”
In the minister’s opinion, the case should go ahead in the Supreme Court, given the senator’s jurisdiction. This is due to the fact that “the facts go beyond the Serra campaign in 2014 and reach the mandate in the Senate.”
Gilmar determined that the Attorney General’s Office should comment on the case, given the “risk of prescription.”
It is worth mentioning that a lawsuit expires when the term provided by law expires, during which there may be some sanction and since Serra is over 70 years old, the statute of limitations is reduced by half and can end until September 11.
The case in question determines whether the toucan received R $ 5 million in the 2014 elections from the health insurance broker Qualicorp without having declared the amount in the electoral accountability.
The count against Serra is part of the electoral arm of the “Lava Jato” operation in São Paulo.
