The Federal Public Defender’s Office filed a public civil action in the Labor Court against what it called the “stamp marketing” of Magazine Luiza for opening an exclusive apprenticeship program for blacks. For the author of the petition, the defender Jovino Bento Júnior, although the social inclusion of blacks and any other group is desirable, the program in question “is not a necessary measure – since there are others and they are available to achieve the same objective -, and it does not have strict proportionality either, since there would be a huge disproportion between the expected bonus and the burden of the measure, borne by millions of workers ”.

The lawsuit charges the retail chain R $ 10 million in compensation for collective moral damages for the “violation of the rights of millions of workers (discrimination based on race or color, making it impossible to access the labor market).”

Even so, according to him, the “format of the program is illegal, and the current one, therefore, seek its compliance with the legislation, making it compatible with the rights of workers to access the labor market and not be discriminated against (…) this cannot happen at the cost of trampling on the social rights of other workers, who also depend on the sale of their labor force to support themselves and their families.

On Monday 5, businesswoman Luiza Trajano, owner of the Magazine Luiza chain, stated in an interview with Live wheel, from TV Cultura, who discovered few black executives in high positions in his company and, therefore, opted for the exclusive apprenticeship program for blacks. “Structural racism is unconscious in people. We need to understand more what structural racism is. The day I understood, I even cried, because I always thought I was not racist until I understood structural racism, ”Luiza said.

The businesswoman said that although she demanded a broader selection of black people in her lawsuits, she received little benefit when looking for people for high positions. “How can we add more blacks if they don’t appear? The starting point is already unequal, ”he said, pointing to the impact of racial inequality from basic education.

Luiza stated that it is not “woo-woo” and that the idea went through a committee before being disclosed. The purpose of the program is to offer 20 vacancies to people from all over the country, with guidelines for HR to receive CVs without the obligation to speak English, for example.

The process is also open to black employees already working for the company. “There are a lot of people who come and help do the show,” he said. With the apprentice, he stated that several people will be trained for managerial positions.
