BRASÍLIA – Minister Alexandre de Moraes is the new rapporteur for the investigation opened in the Federal Supreme Court (STF) to investigate whether President Jair Bolsonaro interfered in the work of the Federal Police (PF). An electronic draw was carried out by decision of the President of the Court, Minister Luiz Fux. He responded to a defense request from former Justice Minister Sergio Moro, who is being investigated in the same case.

With that, the case, which was reported by Minister Celso de Mello, who retired last week, will not stay with Kassio Marques, appointed by Bolsonaro to replace him. Fux, who is president of the STF, was left out of the draw.
Alexandre de Moraes is already the reporter of some processes in which he made decisions that displeased Bolsonaro. He is responsible, for example, for investigations investigating attacks on the Supreme Court and anti-democratic acts. In both cases, it determined actions that were aimed at allies and sympathizers of the president.
Outside of criminal proceedings, the minister has also upset the government on other issues. It was he who suspended the appointment of Alexandre Ramagem to the command of the Federal Police, and ordered the Ministry of Health to resume the dissemination of various data and indicators for covid-19.

On Tuesday last week, Moro, who left the government accusing Bolsonaro of trying to interfere with the PF, called for a new rapporteur to be appointed soon from among the current STF ministers. Moro’s defense highlighted that there is no minister to carry out the investigation and that, if there is a request from an interested party, it is possible to define a new rapporteur, without having to wait for the new minister to arrive.

There is a precedent in the STF. In 2017, when Minister Teori Zavascki, who was in charge of the Car Wash Operation processes, passed away, there was a tie and Edson Fachin became the new rapporteur. The vacancy at the Court would be filled by Alexandre de Moraes, who took most of Teori’s demands, but not Lava-Jato.
