The Public Civil Action filed by the Public Ministry of Amazonas was accepted by the duty judge Leoney Harraquian. The decision must be carried out urgently by the Government of Amazonas

The Justice of Amazonas granted, on the afternoon of Saturday (2), a request for anticipation of guardianship made by the Public Ministry of Amazonas (MP-AM) that determines the immediate suspension of non-essential activities in the State for a period of 15 days. By accepting the precautionary measure, the judge on duty Leoney Harraquian pointed out that the measure takes into account the guarantee of public health safety, since the number of cases and deaths “has been growing overwhelmingly”, according to graphs issued by the Fundação of Sanitary Surveillance Amazonas (FVS-AM). The measure should be valid until January 18.

In addition to the total suspension of non-essential services, the text of the decision obliges the State to indicate, for each category of establishment, the development of essential activity, authorized to operate, measures that avoid the occurrence of overcrowding of people during the service. Another measure to be taken is the daily pronouncement, during the 15 days of restriction, on social networks and media, such as newspapers, radio and television, of the measures to be adopted as the effects of social withdrawal develop. The measures to be carried out follow a technical opinion issued by FVS-AM on December 31 (Thursday).

The magistrate’s decision has the effect of an immediate judicial order, and must be executed by the Government of Amazonas, under pain of a daily fine of R $ 50 thousand to the governor of Amazonas, Wilson Lima. The magistrate also ordered the use of police force to enforce the decision in order to preserve public order.

Today’s judicial determination replaces the last decree of the Government of Amazonas on the opening hours of non-essential commerce, of December 28, making the measures that provided for the closure of services until January 10, with the authorization of the operation of no Essential during the week, at specific times from 8 am to 4 pm, with security protocols and non-working weekends.
