For her, the return to face-to-face school activities is “absolutely necessary”, but it must be done in adequate conditions to avoid risks to the health of students, education professionals and their families.

In her decision, Judge Carla Montesso Eberlein summons the city and the government of São Paulo to clarify a series of questions in ten days:

  • How many and which schools are in their respective educational systems located in the Capital District;
  • What actions have been carried out since July to this moment in each of the public schools in their respective systems – to comply with the health protocols established by the Education Departments themselves, detailing the reforms carried out, improvements in school environments, provision of personal protection equipment and hygiene and sanitation;
  • Clarify how many and what were the training activities for education workers in each of the units, specifying if all schools have a full staff of teachers and other servants and if additional workers were hired, including cleaning activities;
  • Inform the list of schools that, due to structural or conservation problems, still do not have the appropriate environmental conditions to resume face-to-face activities;
  • Inform if there is a scheduled date for the resumption of face-to-face classes and present a schedule of work, preparation of school environments and training actions for school teams scheduled for the month of January;
  • Clarify the measures already adopted or in progress for the control actions of the health surveillance teams and teacher supervision to certify the preconditions of compliance with the protocols for resuming face-to-face activities in private schools;
  • Present, after the initial report, every ten days, information on the progress in the fulfillment of the necessary measures for the preparation of school environments and equipment and on the updates of the schedule for resuming face-to-face activities;
  • Clarify whether education workers are expected to be included in the priority publicity of the vaccination plans that have been made known, in particular the one presented by the São Paulo state government.
