Justice determines the departure of tourists from Buzios and closes the city until the end of the month

One of the most sought after destinations by the judges for the end of the year, the city of Búzios, in the Rio de Janeiro Lakes Region, is prohibited from receiving tourists until the end of December. In addition, tourists will have to leave the city within 72 hours, counting from this Thursday (17). The decision was made by the Rio de Janeiro Court of Justice (TJRJ), which determined the immediate suspension of the flexibility measures adopted by the City Council.

According to the TJRJ, all recent relief measures taken by the city are revoked. With this, beaches, hotels, inns, among others, should be closed. Judge Raphael Baddini de Queiroz Campos, from Court 2 of Armação de Búzios, ordered the suspension until the end of December or until the terms of the Term of Conduct Adjustment (TAC) are met.

The magistrate considered that the municipality did not comply with the commitments established in the TAC signed with the Public Ministry and the Public Defender’s Office. The TJRJ noted that the City Council did not increase the number of hospital beds in the Intensive Care Unit (ICU), as agreed. “Confirmed cases of ‘COVID-19’ in the city increased by 453 in seven days, with the same eleven ICU beds reportedly available when the TAC was signed,” the judge wrote in his decision.

According to the TJRJ, the magistrate recognized that the municipality is in the Red Flag stage – risk 3-, that is, at high risk of collapse of the health network and the need for complete social isolation. If the City of Buzios does not comply with the decision, it will receive a fine of R $ 100 thousand per day of non-compliance.

According to the Municipality of Búzios, restaurants only work again in delivery systems and only stores that provide essential services are allowed, such as pharmacies, markets, fresh products, bakeries, animal products stores, gas and mineral water distributors, respecting the maximum occupancy of 30% of its capacity.

On its website, the Municipality of Búzios also announced that it will comply with the court order, while the legal department analyzes any recourse. “The judicial decision is based on a Behavior Adjustment Term signed with the Public Defender’s Office in June 2020, and which until now has not been fulfilled. The Municipality of Búzios reports that since October 21, the date on which the current administration took office, several items of the TAC have been fulfilled, such as the increase in the number of hospital beds for Covid-19 and the availability of special care for patients with symptoms of the disease, “says the note.
