The Brazilian Association of Bars and Restaurants (Abrasel) achieved this Friday (11/12) a mandate that allows the sale of alcoholic drinks in pubs me restaurants from Belo Horizonte.

The decision was made at the end of this afternoon in the first instance by the law judge Maurcio Leito Linhares, of the 1st Court of Skills of the Municipal Public Treasury of the District of Belo Horizonte. Look at the text:
“I grant the request for the granting of a preliminary guarantee so that the illustrious interposed authority (Belo Horizonte City Council), by itself or by its agents, abstain, based on Municipal Decree No. consumption of alcoholic beverages in associated establishments (Abrasel), as well as applying any healthy in this regard, sanitary protocols already provided for in the SMSA / SUS Ordinance 328/2020, under penalty of setting FINE DIRIA ”.

In the text of the decision, the judge says that it is difficult to define what really stimulates the increase in COVID-19 indicators in Belo Horizonte due to the breadth of activities in the city. He adds:

“However, it is not difficult to conclude that the consumption of alcoholic beverages in these establishments, by itself, does not represent a relevant cause of increased transmission, even because the most important, as many renowned Brazilian doctors and scientists say, foreigners, at the current stage of the Sars-Cov-2 virus outbreak, prevention. With or without drinks, in theory, bars and restaurants will continue to be frequented, but for commercial establishments the loss of income is an obvious consequence, with a reduction in the ability to pay the most varied debts and keep employees, “he wrote Maurcio. Bed.

The city government’s ban on alcohol consumption, according to the judge, was disproportionate. Maurcio Leito believes that Belo Horizonte “is aware of the need to respect health protocols at home, in the streets and in places where the public has access.”

“What the Public Administration must charge is precisely respect for health protocols, since it is not possible that, considering that not all respect them, there is a serious and punctual restriction, and nothing reasonable, aimed at a relevant sector of the economy of this municipality, in the case of bars, restaurants and the like, which exist here in enormous quantities, ”the judge wrote.

The Belo Horizonte City Council said it had not yet been notified of the court order.

The ban began on Monday, December 7. The decree published by the Municipality of Belo Horizonte in the Official Directory of the Municipality (DOM), nº 17,484 (read in full), signed by Mayor Alexandre Kalil, took into account “the systematic analyzes of epidemiological indicators and care capacity carried out by the Committee of Coping Epidemic of COVID-19 “.

According to the new decree, bakeries, cafes, bars, restaurants, canteens, clubs, ice cream parlors can continue to serve food to customers on site, less alcoholic beverages. The restriction also applies to public or authorized fairs on public and private properties in Belo Horizonte.
