Judge I’talo Fioravanti Sabo Mendes, of the Federal Regional Court of Region I, accepted the request of the Union and suspended the payment of two more installments of R $ 600 as emergency aid for the residents of Amapá affected by a blackout that started on last day 3. The decision was published on Friday (20).

In the decision, the magistrate emphasizes that he is not trying to “assess the merits of the issue discussed in the original case, since the merits issue, if necessary, will be examined in due course in the corresponding court.”

“The granting of the suspension of the execution of a precautionary measure, relief or emergency sentence, within the framework of a procedure of competence of the Presidency of this Federal Regional Court, constitutes a narrow and exceptional path, which is predetermined for the purpose to avoid serious damage to public order, health, safety and the economy, “he writes.

The Federal Government, through the Office of the Attorney General of the Nation (AGU), presented yesterday the request for the suspension of a precautionary measure that had granted two more installments of emergency aid.

According to the AGU, the payment of the aid “would overload the public coffers, to the extent that it will lead to an estimated cost of more than R $ 418 million, without having, at the present time, a specific budget forecast.”

AGU also said that the measure determined by the Amapá Justice violates the functional separation between the powers by invading the scope of the administrative organization of adequate budgetary-financial planning in social assistance.

Yesterday, the president of the Senate, Davi Alcolumbre, who is from the state, met with President Jair Bolsonaro and the Minister of Economy, Paulo Guedes, in search of a solution to the issue.

According to sources, Guedes said that there are mechanisms to compensate the State through the FGTS, unemployment insurance or even the creation of social aid, but the economic team has not yet defined the aid model.

This Saturday, at the invitation of Alcolumbre, Bolsonaro will visit Macapá.
