The decision was made by the Federal Supreme Court (STF) last Monday 26. Until then, the INSS only considered as special time the period in which the insured was absent in the field of accidental illness. That is, due to disabilities caused by the occupation.
However, the agency now also counts social security sickness benefits as special time. This type of assistance is aimed at cases in which the incapacity for work is not directly related to the professional activity.
In practice, the taxpayer may convert the period of absence due to any illness, even outside the profession, into a special retirement. The rule is valid for special pensions It pays working citizens exposed to agents that are harmful to health and physical integrity, such as heat or noise.
Sickness benefit
It is a disability benefit for the INSS insured who proves, in his medical experience, that he is temporarily unable to work due to illness or accident. The payment is made when the worker cannot perform the function for more than 15 consecutive days. Thus, as of the 16th, Social Security takes over the salary of this employee.
However, to be entitled to sickness benefit, the insured must have contributed to the INSS for the minimum period 12 months. The exception is if the leave is due to an accident at work. In this case, it is not necessary for the worker to complete a grace period.
