The president of the Chamber of Deputies, Rodrigo Maia (DEM-RJ), said on Tuesday (27) that the Executive and the Legislature must reach a solution together on whether or not a possible vaccine for Covid-19 is mandatory.

According to Rodrigo Maia, without this agreement, the government and Congress will leave a “vacuum”, which would require a response from the Judicial Power to the issue.

The president of the Federal Supreme Court (STF), Minister Luiz Fux, has already said that he considers “necessary” the “judicialization” of the criteria to be adopted for vaccination against the new coronavirus.

For his part, the President of the Republic, Jair Bolsonaro, has reiterated that he is against the mandatory vaccine. On Monday (26), for example, he told his supporters that a judge “cannot decide whether to get vaccinated or not.”

“I believe that the Executive and Legislative branches need to find a way. We must not leave an open space, that void so that, once again, the Supreme Court decides and that both the Executive and the Legislature complain about certain activism of the Judicial Power, “said Maia in a press interview in the Chamber.

Currently, four actions in the Federal Supreme Court (STF) address the issue: three in favor of a more comprehensive and / or mandatory vaccination and one that calls for the prohibition of mandatory vaccination.

For the mayor, the government and the legislature are the “right environment” to tackle the problem.

“I think the government and the legislature should organize this vaccine issue because I think it is the right environment. The government, added to the home of the population [Câmara] and the federation house [Senado]I think it would be better than a decision sent by the Supreme Court of Justice of the Federation, that if nothing is done, obviously, it will decide again instead of the Executive and the Legislative ”, he said.

Rodrigo Maia said that mandatory vaccination can be debated, but that this will depend on the authorization of the National Health Surveillance Agency (Anvisa).

“The question of whether it is mandatory or not is a question that can be debated. The question of the vaccine depends on Anvisa, it does not depend on any of us. In fact, it is the correct one. We should never approve an authorization for something that exists in an organ, an independent agency to make this decision. So, it is obvious that, from my point of view, all vaccines will be welcomed after, of course, approved by the regulatory body, by Anvisa, “he said.
