There are four actions presented before the Supreme Court, amid the controversial statement of the president Jair bolsonaro that it will not authorize the importation of vaccines from China by the federal government, in a speech that pleases the ideological wing of the government, which preaches that vaccination is not mandatory.

The five parties also request the government to deliver, within 30 days, plans and programs related to the vaccine and drugs against covid-19. The Sustainability Network, in another action, also requires the federal government to submit a vaccination plan.

Two other actions were presented by the Democratic Labor Party and in Brazilian Labor Party, with divergent orders. For the PDT, in opposition to the government of Jair Bolsonaro, the Supreme Court must recognize the competence of the states and municipalities to determine whether the population is vaccinated or not. On the other hand, PTB, from the allied base of the President of the Republic, requests that this possibility be declared unconstitutional.

All of these requests reached the Supreme Court on the same day as the Chief Justice, Luiz fux, predicted a flood of vaccination lawsuits. The minister demonstrated that he agrees with the need to debate some of the fundamentals that are being discussed in society.

“You can write, there will be a judicialization, which I think is necessary, on this issue of vaccination. Not just individual freedom, but also the prerequisites for adopting a vaccine. I am not advancing any point of view, I am only saying that this judicialization will be important, “he said.

Fux’s speech came at a time when the minister said he intends to see the Supreme Court “respected.” “I do not want the judicial role of the Supreme Court to interfere in matters that are not within its competence, in light of the separation of powers,” he said, before speaking about the judicialization of vaccination.
