The President of the Republic, Jair Bolsonaro (without party), sanctioned with a veto, this Tuesday (13), the text that modifies the Brazilian Traffic Code (CTB). The sanction is carried out more than a year after the delivery of the project that the president made personally to Congress. Among other points of the text are the doubling of the point limit for the driver to lose the National Driving License (CNH), which now goes to 40, and the extension of the validity of the document for drivers under 50 years of age. years.

The new law comes into force in 180 days and the text should be published in the Official Gazette this Wednesday (13).

President Bolsonaro announced only one of the vetoes during a live broadcast on social media on Tuesday. It dropped the section included by the Legislative that involves motorcyclists, who can only travel between vehicles when traffic is stopped or slow.

According to Bolsonaro, this measure is not necessary, because “the motorcyclist takes care of his life.”

“It’s on top of that train over there. I’ve always taken care of my life, I was a motorcyclist for a long time.”

The bill with the changes in the CTB rules was delivered to the mayor, Rodrigo Maia (DEM-RJ), in June of last year by Bolsonaro. Since then, the PL has become a mandatory flag, advocating less stringent rules for drivers who have committed infractions. The text was approved by Congress at the end of September.

“The bill was voted in the House and the Senate, some things were changed. It was not what we wanted, but there were some advances. Our intention was to make life easier for the driver,” said the president.

Renewal

Among the main changes sanctioned now is the extension of the validity period of the CNH. Currently, CTB says the document must be renewed every five years for drivers up to age 65. After that age, drivers must renew every three years.

Duration

Now the validity is extended to ten years for drivers up to 50 years old. Between the ages of 50 and 70, physical and mental fitness tests must be repeated every five years, the same timeframe for application drivers engaged in paid activity in vehicles. After age 70, renewal must be done every three years.

The text also expands the maximum point limit for a driver to lose his license. Before you needed 20 points. Now there are 40. But only for drivers who do not commit a very serious offense. If there was an infraction of this size, the limit is reduced to 30 points. With two or more offenses of this type, the maximum score is again 20 points.

Alternative sentences

In addition to the aforementioned extensions, the changes also include a device that prohibits drivers from driving while intoxicated and being liable for crimes of homicide and personal injury without the intention of replacing prison terms with alternative penalties.

The new law also requires the use of the car seat for children up to ten years old who have not reached 1.45 m in height. They must be transported in the back seat of vehicles.

Waiting areas

The text also provides for the adoption of waiting areas for motorcycles next to traffic signals, in front of the containment line of other vehicles, and changes the level of the offense committed by cyclists who travel with their headlights off to very serious.

Headlights on

The project requires the driver to keep the headlights on also in times of rain, fog and fog. In current law, the requirement is only for those who travel at night and, during the day, in tunnels. Another section of the new law requires the use of low beams during the day only on single-lane highways located outside the urban perimeter.

Driver registration

Finally, the project creates a positive driving record, with the intention of registering drivers who have not committed a traffic violation subject to scoring in the last 12 months. The Federal Government, the States and the municipalities can use this registry to grant fiscal or fiscal benefits to the drivers registered in it.

Still live, Bolsonaro promised that he will present, in 2021, new changes, including some that were repealed in the Legislature.

“Next year we will improve even more because you have to believe in people. Because only in this way, in my opinion, we achieve a conscience where everyone is profitable, in a good way ”.

The president also said that he intends to insist on the end of the exclusivity of specialist doctors to carry out the medical examinations necessary to obtain or renew the driver’s license.

“We want the health inspection to be carried out by any doctor,” he concluded.
