Celso de Mello expands investigation on Bolsonaro’s interference in the FP

On the eve of retiring from the Federal Supreme Court (STF), Minister Celso de Mello decided to extend the investigation that investigates whether President Jair Bolsonaro politically interfered with the Federal Police for another 30 days, as accused by former Minister of Justice Sérgio Moro. In his order, Mello authorized the request made by the PF, which had the favorable opinion of the Attorney General’s Office.

It is possible that the new Minister of the Federal Supreme Court will take over the complaint of the case. President Jair Bolsonaro appointed Judge Kassio Nunes Marques to fill the vacancy of Celso de Mello, who is the Dean of the Court and retires on the 13th. It is customary in the STF that new ministers inherit the demands of their predecessors.

However, there is the possibility of a redistribution of the rapporteur, so that the case that threatens Bolsonaro does not remain in the hands of his nominee. The name of Marques was sent by the president to the Senate, with the support of Centrão, a group that groups together center and center-right parties. On social media, however, Bolsonarista militants oppose the nomination, arguing that Marques is not a defender of the conservative agenda. It will be up to the senators to judge the judge to confirm or reject the nomination.

Celso de Mello also requested on Monday the 5th that the Supreme President, Minister Luiz Fux, include Bolsonaro’s appeal on the court’s trial agenda, seeking authorization to testify in writing in the investigation in which he is being investigated.

The expectation is that Fux indicates the trial process as early as Wednesday 07, due to the proximity of Mello’s retirement. Fux aides say it would be difficult for the president to reject this “latest request” from the Dean of the STF.

Mello had determined that Bolsonaro testify in person before the Federal Police, who even sent a letter to Planalto to make the appointment. But the Office of the Attorney General of the Nation (AGU), which defends Bolsonaro in the investigation, requested that the president have the same right previously granted to Michel Temer, his predecessor in office.

Two Supreme Court ministers, Luis Roberto Barroso and Edson Fachin, allowed Temer to give written testimony in the investigations in which he was being investigated. The Attorney General’s Office agreed with Bolsonaro’s defense request.

During a period of sick leave for Celso de Mello, Minister Marco Aurélio Mello, replacing the dean, made the decision to suspend the investigation, until the full court decided the AGU’s request.

The investigation seeks to identify whether Bolsonaro acted illegally in determining changes in the command of the Federal Police. Suspicion was raised by Moro, who decided to leave the government after the president removed the general director of the PF, Maurício Valeixo. Moro had appointed Valeixo to the position and had a man of confidence in him.
