The Court of Justice of the Federal District and Territories (TJDFT) decided that within 10 days a new date must be defined for the performance of objective and discursive tests of the contest of the Civil Police of the Federal District (PCDF).
The decision of this Thursday (9/24) also establishes that the Superior School of Civil Police of the Federal District and Cebraspe – the organizing table of the event – carry out the exam within a maximum period of 90 days.
The contest was canceled on September 14 due to the Covid-19 pandemic.
The selection of agents and administrators of the PCDF foresees, in total, 600 vacancies to fill immediately and another 1,200 destined to reserve records. The quiz is in the right or wrong mode: an incorrect answer cancels a correct answer. In total, there are 120 articles.
Explanations
In the last week, the TJDFT had already summoned the local Executive, the organizing board and the Civil Police to explain the suspension of the contest. The demonstration was the result of a popular action with a request for amparo filed by a candidate.
In the lawsuit, the Brasiliense also asked the Justice to maintain, in a preliminary manner, the performance of the test on October 18 (originally scheduled date). The request, however, was denied by Judge Daniel Eduardo Branco Carmacchioni, of the 2nd Court of Public Finance.
In the decision, the Federal District Justice pointed out that the motivation, justified by the Board of the Escola Superior da PCDF, would be the risk of contagion by the new virus. The magistrate affirmed that the justification would be “absolutely legitimate and reasonable, if not for the conduct of the public administrators who preceded that administrative decision.”
For Carmacchioni, the PCDF was wrong to publish the announcement of the corporation’s tender “in full swing of the new coronavirus pandemic” in the country’s capital. “At the time, without any concern for public health, the announcement was published, with the opening of the registration period, term for payment of fees and schedule of tests,” he defends in sentence.
In addition to the publication of the notice in the midst of the Covid-19 pandemic, the magistrate also questions the fact that the tests were suspended after the deadline for payment of registration fees had expired “at a time when the Federal District itself It is making activities that cause crowding of people more flexible ”.
“What is observed is a total absence of planning for the aforementioned public tender, so much so that the announcement was published in the worst scenario of the pandemic and the suspension of the tests occurs only after the last term foreseen for the payment of the fee of inscription “, criticizes the magistrate.
For this reason, it requested the GDF and the Board of Trustees of the Escola Superior da PCDF to present a technical-health report capable of showing the impossibility of performing the test due to health safety issues.
Suspension
On September 14, PCDF announced the cancellation of the public selection tests, without disclosing a new date for the event.
The decision, announced by director Gláucia Cristina da Silva, was made due to the “substantial number of candidates from other registered Federation units.”
Gláucia said that the corporation also took into account that “the epidemic curve of the Covid-19 virus still requires attention in the Federal District.”
According to the general director of the PCDF, delegate Robson Cândido, the exam is at the national level, with candidates from almost all the federated units registered. “For this reason, in conversation with the organizers of the contest, we decided to suspend the tests, without a deadline to reschedule, due to the pandemic caused by the new coronavirus. As soon as there are solutions to the health issue, the new date will be informed, “he said.
