In the representation, the deputy attorney Lucas Furtado asks TCU to evaluate compliance with the promotion – revealed by the Power 360 website – “with the exceptional legal measures adopted during the state of public calamity resulting from the new coronavirus pandemic.”

It also requests that the salary increase resulting from promotions be suspended until the Plenary of the Court decides on the merits of the matter.

In the Office of the Attorney General of the Republic, the starting salary is R $ 21,014 and the final salary, R $ 27,303. It is because of this last category that all these federal prosecutors are migrating with promotions. In the Office of the Attorney General of the Federal Republic, 93.3% of current lawyers (3,489 of a total of 3,738) are at the peak of their careers.

For Furtado, the promotion is void. “The aforementioned promotion is null and void, in view of the exceptional legislation currently in force at the time of the public calamity resulting from the Covid-19 pandemic.”

Also according to the deputy prosecutor, the promotion, with an increase in the salary of the prosecutors, limits the company.

“The increase in remuneration for the category in question, at this time, restricts Brazilian society. According to him, “it is hard to believe” that it was granted in a “situation so sensitive that we live in, when the health, economic and fiscal crises accumulate.”

Prosecutors promoted defending the federal government in judicial and extrajudicial actions and are responsible for the collection of resources that municipalities and foundations must receive.

Promotions were provided by law according to two criteria: seniority and merit. AGU said the money for the promotions is in the budget, but did not disclose the cost.

The Federal Prosecutor’s Office said in a note that “all acts related to its employees are carried out in strict compliance with the legal and regulatory provisions” and that in the first six months of 2020, only through collections and judicial agreements, more than R $ 2 billion.

The president of the National Association of Federal Public Lawyers, Marcelino Rodrigues Mendes Filho, affirmed that the promotions are legal.
