The Legislative Assembly of Rio de Janeiro (Alerj) takes another step in the impeachment process of Wilson Witzel (PSC) and votes, this Wednesday (23), on the opening of the criminal responsibility process against the outgoing governor, suspected of corruption in the health area.

The continuation depends on the approval of 47 votes, that is, two thirds of the total of 70 deputies.

Voting can take more than one day. That’s because each of the 25 parties has one hour to speak, as does the governor’s defense.

If the political trial is approved by the plenary session of the Chamber, the case goes to a mixed court made up of five deputies and five judges of the Rio Court of Justice (TJRJ).

From the installation, the court has up to 120 days to conclude if there was a crime of responsibility.

If so, Witzel would be removed from office. He is already dismissed preventively by another decision, by Minister Benedito Gonçalves, of the Superior Court of Justice (STJ).

The minister says that the Federal Public Ministry (MPF) discovered a “sophisticated criminal organization, composed of at least three powerful groups, headed by Governor Wilson Witzel.”

Last week, the impeachment processing commission approved the report by the rapporteur Rodrigo Bacelar (Solidarity) who unanimously defended the continuity of the action: 24 to 0. Only one deputy, absent with Covid-19, did not vote.

In June, the opening of the impeachment process was submitted to a symbolic vote, although it depends only on the approval of the president of the Chamber, André Ceciliano (PT).

What does the complaint against Witzel say?

The impeachment request was based on an alleged administrative irregularity and misuse of public money in health care amid the coronavirus pandemic, based on operations Placebo and Favorite.

Both actions investigated allegations of embezzlement of portfolio funds and resulted in Operation Tris in Idem, which removed Witzel from office on suspicion of corruption.

Is accused of take bribes from companies linked to the scheme through bogus contracts signed with First Lady Helena Witzel’s office. The outgoing governor, who denies the charges, would have received at least R $ 554.2 thousand.

The Attorney General’s Office (PGR) revealed the scheme after finding irregularities in contracts for field hospitals, respirators and medicines.

According to prosecutors, the governor has “active participation in the knowledge and domain of contracting with the investigated companies.” The exchange of emails would show suspicion.
