Judge Peixoto Júnior, of the Federal Regional Court of the 3rd Region, suspended the reopening of the branches of the National Institute of Social Security (INSS) and the face-to-face work this Monday (14) in the state of São Paulo. The INSS will appeal the decision.
In a note, the INSS reported that the agencies will remain closed after the court decision and that “policyholders who had scheduled care should ignore and proceed with the reprogramming by Meu INSS or by calling 135.” (see full note below)
In the decision, the judge evaluated that the resumption should only occur after “new inspections and presentation of a safe plan” by the health authorities, in addition to testing Covid-19 for all INSS servers in the state.
“In view of the above, without prejudice to the reanalysis by the natural rapporteur, I grant, in this cognitive summary phase, the requested urgent relief, determining the suspension of the reopening of the INSS agencies on 09/14/2020, as well as the suspension of face-to-face activities. , with the maintenance of remote work, all this until future review of the framework by the health authorities, new inspections and presentation of an effective and safe plan for the resumption of work by the INSS, as well as effective tests for COVID- 19 of all the servers (as) of the INSS of the State of São Paulo ”, says the decision.
The Union of Social Security and Social Welfare Workers of the State of São Paulo was the one who filed a lawsuit demanding the suspension of the reopening and maintenance of remote work.
After months closed due to the coronavirus pandemic, INSS agencies are beginning to reopen in part of the country for face-to-face assistance this Monday. In this first stage, however, the agencies will only serve scheduled policyholders.
For the reopening, an ordinance published on Friday (11) in the Official Gazette of the Federation established the preventive measures to be adopted.
Initially, service will resume in more than 600 of the 1,500 branches in the country. The institute chose to reopen the largest agencies, which account for about 70% of demand. The opening hours will be from 7 a.m. to 1 p.m.
“In this first phase, priority will be given to medical expertise, social assessment, compliance with requirements, administrative justification and professional rehabilitation services,” the Ministry of Economy reported in a note.

The INSS, through the Specialized Federal Prosecutor’s Office – INSS (PFE-INSS) will appeal the decision, and hopes that the Justice understands the essential nature of the service provided by this Municipality.
The INSS points out that the reopening of the agencies is essential so that part of the population that needs face-to-face services is not harmed, especially at this pandemic moment.
