RIO – Civilian police from the Commissariat for the Repression of Organized Criminal Action (Draco) carried out Operation Freedom this Tuesday afternoon to execute nine search and seizure orders against servers who were part of the group “Guardians of the Crivella.” Employees were paid to assault journalists, patients, and family members who filed complaints about the municipal health system. The complaint was broadcast by “GloboTV”, of TV Globo, on Monday night.
The group will be investigated for crimes against the security of the public service, criminal association and administrative law. Together, the sentences can reach up to nine years in prison. The orders were issued by the night shift judge of the Rio de Janeiro State Court of Justice (TJRJ).

Appointed as head of the ‘guardians’ by Draco, the city’s special adviser, Marcos Luciano, was targeted by the operation and led to testify. He was accompanied by a lawyer. GLOBO learns that Crivella’s assistant is being investigated in three inquiries about his possible involvement with the militia. Previously, in an interview with the newspaper, Luciano said that “he had nothing to hide” and added that he would only be “a servant at the service of the city.”
At the assessor’s house, in Olaria, the investigators find a package written “Crivella.” The material will be examined. Luciano’s cell phone was also seized, about R $ 10,000 in cash and documents.
According to the chief of police William Pena, head of Draco, the server Marcos Aurélio Poydo Mendes, who lives in Morro da Galinha, Engenho da Rainha, in the North Zone, mocked the agents when they told him on the phone that he would have to go to Draco. He said agents should send a subpoena to “Crivella’s office.”
Three of those investigated will give testimony in the specialized one this Tuesday, and the others will be summoned during the week. Luís Carlos Joaquim da Silva, Dentinho, was also sent to the police station.
According to the Civil Police, the operation had to be carried out quickly so that those involved did not destroy the evidence. According to Peña, if Mayor Marcelo Crivella is involved in the crime, the investigation will be sent to the Criminal Prosecution Group (Gaocrim), of the Public Ministry. There was a phone number assigned to the prefect of the employee message group.
– If at any point in the investigation we reach an agent with a forum, we will refer him to the Coordinator of Investigation of Agents with Forum (Ciaf) who works in alliance with Gaocrim – said Peña.
MPRJ initiates criminal proceedings
The Public Ministry of the State of Rio (MPRJ) instituted, on the morning of this Tuesday, a criminal preparatory procedure to investigate the alleged practice of crimes that the mayor Marcelo Crivella would have committed for the creation of the group ‘Guardians of Crivella’. The investigation will be in charge of the Office of the Attorney General for Criminal Justice and Human Rights, with the support of the Criminal Origination Attribution Group of the Attorney General’s Office, both from the MPRJ.
In addition to the crime of criminal association, provided for in article 288 of the Penal Code, the investigators of the Office of the Assistant Prosecutor will evaluate the practice of criminal conduct in article 1, paragraph II of decree law 201/67, which establishes the responsibility of mayors. The conduct of the public servants who worked in the group will also be analyzed. According to a specialist heard by GLOBO, the mayor can also answer for the crime of administrative improbity.
