The lawyer of the 30-year-old detainee for the attack on the policeman in Nea Smyrni, Pavlos Sarakis, issued a statement on the occasion of a video in which the 30-year-old is said to be in Elefsina on the day in question.
The announcement states that:
Today we publish a video of the park in “Limanaki” of Elefsina, which fully verifies the complaints of our client, but also of the witnesses, who on Tuesday March 9, at the time in question, was in West Attica and not in N Smyrna.
It is tragic that EL.AS. and the Greek Justice was seduced by a mentally unbalanced person, arrested and handed down a very serious accusation to one of our innocent fellow citizens. And not only that, they provocatively imprisoned him ignoring the defense evidence and testimony. Now it is the investigator’s obligation to order the lifting of the temporary detention at home, based on article 291 § 1 of the Code of Criminal Procedure. Failure to do so, the Justice Department must intervene and control disciplinary and criminally for their acts and omissions. “It is inconceivable and an important issue, for a European rule of law, the preventive detention of an innocent citizen of ours, not only without evidence, but contrary to the evidence that completely refutes the accusation against him.”
The description of the videos according to the defense:
The videos come from a restaurant – tavern, which is located right in front of the Elefsina park. We have at our disposal the video material that covers the entire period 18:00 – 22:00 on 03.09.2021, that is, the chronology of the episodes.
The first fragment shows the accused (“Indian”) arriving on foot at Elefsina Park at 18:21 with a black uniform, a dark sweatshirt and a blue vest with gray details (the same one he was wearing when he appeared before the Investigator for his apology), as described by witnesses in their testimonies. The video fully confirms the testimonies of the witnesses, after the defendant enters the park, meets his friends there and plays basketball with them.
The second fragment shows the departure of the accused and his friends, pedestrians, from the park in question at 6:45 p.m. During the entire interval, as confirmed by the video, the accused and his friends continue to play in the same place. Leaving the park, they go to the house of one of their friends, where they remain until 7:20 p.m. to 7:30 p.m., as they themselves had testified before the Investigator.
It should be noted that from the point where, as the video in question shows, the defendant is at 6:45 p.m., the distance to N. Smyrni square is at least 35 minutes by VEHICLE AND WITHOUT MOVEMENT (the defendant has no vehicle , without a driver’s license and all those who are in the place arrive by MMM or on foot).
The square is already blocked at the moment to the passage of vehicles due to the thousands of protesters and the episodes that have already begun to unfold, as described in the documents of the case. Therefore, even if you were to drive to the surroundings, you would have to walk on foot to reach the point of attack, that is, at the junction of Plastira and Agia Fotini streets, covering a distance of at least 10 minutes!
As is evident, given that the attack on the unfortunate policeman occurs at 7:20 p.m., although after 8 hours of work in the warehouses and 30 minutes of sports, the accused (¿¿¿¿¿¿¿¿¿ ??? ??????????? ??? ) = incidents, it was practically impossible to be at that point at the moment in question!
This video is a clear proof of what the defendant is doing from the first moment of his unfair involvement, that is, not only did he not participate in the episodes, but he was not even in the N. Smyrni square that day. He fully confirms the testimonies of the five (5) defense witnesses and proves that the “testimony” of his mentally unstable son-in-law, who has already reconstructed it 4 (!) Times, is completely false and is a product of fiction. .
It is recalled that the 30-year-old was arrested based on the testimony of a man who stated that on the night of the episodes he saw the 30-year-old at the intersection of Agia Fotini and Plastira. As he stated, while walking towards Syggrou Avenue, he saw the defendant and asked him: “What are you doing here … will you do episodes? He replied “why, will you give it to me? and he replied “yes dry, if you make incidents and make fun of the policemen”.
In his testimony he affirms that “immediately afterwards I heard someone from the crowd shouting that the police are coming with the ducklings” and I saw him running fast, along with other people the police who were passing with the ducklings, arriving first. and started kicking a downed cop. A. He was wearing dark tracksuits with a white stripe down the sides and a khaki jacket that had some kind of light print on the back. “
Police arrested the 30-year-old in Magoula, on his way home. He had quit his job as a grocer in a large food store in Aspropyrgos.
The 30-year-old man was transferred to the Public Prosecutor’s Office, within the framework of the case that had been initiated against unknown persons for the attempted murder of the policeman.
Deny the accusations from the outset. He even claims that he was not present in the episodes, while he claimed that during the disputed time of the events he was in West Attica and not in N. Syrni. A claim that, as he himself says, will be confirmed by the lifting of the privacy of the phone and in particular by the detection of GPS at the moment in question. He even distanced himself from his involvement in a family feud.
