Draft new sports law
Dear president,
We confirm the receipt of your letter dated September 10, 2020 regarding your conversations with the Vice Minister of Culture and Sports about the electoral process of the Hellenic Football Federation (EPO). FIFA and UEFA take note of the presentation of the new sports law that is currently being debated in Parliament and that could be adopted on September 17, 2020. We understand that although the EPO has broad autonomy with regard to specific aspects of the elections, the new proposal The law contains provisions that would delay the election of the executive body of the EPO, in violation of the current bylaws of the EPO.
As we said in our letter of August 18, 2020, the decision of the Executive Committee of the EPO to convene an Extraordinary Electoral Assembly on October 9, 2020 was taken in full compliance with the Statute of the EPO and the relevant provisions of the sports law. current at that time. (according to which these elections must be held in October of the year of the Summer Olympics, that is, 2020). Therefore, FIFA and UEFA expect the EPO to hold its Special Electoral Assembly, as scheduled, on October 9, 2020 in full compliance with its applicable regulatory framework and in accordance with its obligations as a FIFA member association and from UEFA. Furthermore, FIFA and UEFA have not yet received the full English translation of the proposed sports law and are therefore not in a position to comment on its content. That said, we would like to emphasize the fact that FIFA and UEFA are in line with the position of the International Olympic Committee (IOC) as reflected in their letter of September 14, 2020 to the Vice Minister of Culture and Sports (see attachment) .
Similarly, we hope that the proposed law is fully in line with the obligation of the EPO to manage its affairs independently and without undue influence or interference from third parties in accordance with Article 14 para. 1 ed. i and article 19 of the FIFA Statutes and article 7b paragraph 2 of the UEFA Statutes. To this end, we are at your disposal to review the new sports law 2 and assess your compliance with the obligations of the EPO as a member association of FIFA and UEFA (as long as it is adopted by the Greek Parliament).
Finally, we would like to clarify that in the event that the new sports law contains any provision that is contrary to the aforementioned statutory obligations of the EPO and once these provisions come into force, FIFA and UEFA will be obliged to refer the matter to its competent courts.
