In the case of a dispute over the construction of wind turbines, for example, the reference to “public safety” is likely to rule out other interests.
In legal proceedings related to the expansion of bioenergy, wind and solar energy, the reference to “public safety” could limit the discretion of judges, according to WELT AM SONNTAG, business representatives fear. The new rule threatens to become the basis for far-reaching state intervention.
The federal government confirmed that the new constitutional ordinances for green energy should facilitate the implementation of construction applications. “The regulation stipulates a primary public interest in the generation of electricity from renewable energy, as well as a public interest in safety,” the Federal Ministry of Economy said when asked. The definition is important for the discretionary and weighted decisions of public authorities and institutions.
